Royce West Is Suing One of His Constituents for Defamation

In a lawsuit filed in Dallas' 44th District Court on Thursday, state Senator Royce West claims a resident of his district has consistently defamed him and has, more recently, begun stalking him at campaign and other events, including a pair of funerals.

At the events West cites, Bennie Jeffery held signs accusing West of being a "dirty crook" and verbally harassed the senator, the suit claims.

The most recent incident included in the suit occurred at a public event at the Barack Obama male Leadership Academy on June 6. West claims the defendant "took his ill-will to a new and dangerous level" and that " a barrage a racial epithets and profanity [caused] West to believe he was in imminent danger and fear for his personal safety and welfare."

Dallas police were notified of the June 6 incident and issued Jeffrey a citation for disorderly conduct. The suit claims that the citation and the events that lead to it prove that Jeffery's "malevolent obsession with West and his public denigration and defamation of the senator has now crossed a line into dangerous fixation."

West's suit seeks both temporary and permanent injunctions against Jeffrey. which would restrict him from any contact with West -- physical, written, by text, phone or otherwise. The defendant would be restrained from coming within 1,000 feet of the senator.

The suit also seeks damages for defamation, because, the suit alleges, Jeffrey called West a "dirty crook" and made other accusations against West he knew were false.

Interesting.  The good Mr. West presents as evidence only his affidavits and the police report.  The police report states the incident in question occurred on June 6, but was not reported until June 13th.  If West felt 'in imminent danger and fear for his personal safety and welfare.', why didn't he call in the police right then, when that imminent danger was allegedly right in front of him?  West, in his petition provides for no witnesses, that I saw (admittedly, I didn't read the whole thing), and rests his entire case on his account of what has transpired.  Does this sort of thing usually work?

"Dirty crook" seems so incredibly non-specific and vague that I can't imagine it rising to the level of defamation when talking about a politician.

It's sad when some criminally insane individual becomes obsessed with someone like this. 

Back in the 1950's we used to have hospitals where they could stay - but now they're given SSDI checks instead and allowed to mix with the rest of us until they eventually gun someone down, commit suicide, or get locked up for stalking a public figure.

Imagine - all the mass murders of the last few years that could have been stopped if the shooter had just had some sort of facility like that where he could get the treatment he needed,

If holding defamatory signs and menacing people was a crime, it would be another reason to put JWP in jail.

Mr. West and Mr. Wiggens should be worried about being sanctioned for violating the Civil Practice & Remedies Code, Chapter 27.  Royce West is the best, most black-letter law example of Public Figure.  Given the numerous investigations Mr. West has been the subject of, the idea of there being wreckless disregard behind calling him a "crook" is a non-starter.


Time to put the Texas Anti-SLAPP rules into practice.

@bvckvs Quite a few of them are already being treated.  The San Diego shooter, for example, was said by his father to be in "therapy pretty much every day."


Sometimes people snap, and even medical professionals can't predict it.  (Assuming that if his therapists had known he was dangerous, they would have urged commitment, since he had the money for a private facility.  If not, that's malpractice for them.)

Quite a few doesn't seem to be enough.  And since boutique therapists who charge by the hour have a financial incentive to keep their patients coming back, that isn't working either.

We need a more robust approach.
