Unpaid NTTA Tolls Can Apparently Land You In Jail

Of late, the North Texas Tollway Authority has been testing out a host of new methods to encourage drivers to pay their tolls. The agency will block your vehicle registration and impound your car. It will publicly shame you. It will sue you.

Sometimes, though, nothing works as well as a good, old-fashioned jailing, like the one given to alleged toll scofflaw Florence Moka.

According to the NTTA, Moka racked up more than $14,000 in fines and fees driving on North Texas toll roads, which is a lot. But it's also a far cry from the six figures racked up by the most egregious offenders. So why Moka?

The short answer is that not only did she ignore repeated mailings from the NTTA -- which, however much its leaders might wish to the contrary, does not have police powers -- she also ignored an order to appear before Collin County Justice of the Peace Mike Yarbrough.

"These are two warrants for failure to appear in court on citations issued by DPS for failure to pay tolls," says NTTA spokesman Michael Rey. "These failure-to-appear warrants are issued by the court -- not NTTA -- when the violator fails to show up in court for the hearing on the citations."

Moka was still in jail this morning, being held on a $365 bond, records show.

According to a 2012 NTTA newsletter, the agency sends 15,000 toll violation cases to JP courts each year. These sometimes result in arrests -- back when he was at the Star-Telegram, Dave Lieber wrote about a woman jailed over an $11 toll bill -- but such cases seem to be rare.

Bluntly,  something had to be done to get the lady's attention.  Judge quite properly,  after she was given notice of the Hearings and didn't show,  sent the Constable out to get her,  to bring her to Court.  The bail is to ensure her appearance at the next Hearing.

Although,  somebody who runs up $14,000+ by zipping through toll gates not giving a damn that she was likely to someday get caught,   wouldn't be expected to have a lot of respect for a Court's notice of Hearing.

So, she wasn't jailed for tollway fines.  She was jailed for "failure to appear".  Had she shown up at court, she would have been allowed to walk away.

So not only does the government not use it own gas tax dollars to build roads anymore, the will also spend tax payer money to enforce the toll road corporations.

Girlfriend could have gone on for years and would have made it to the six figure club eventually.  But no.  She had to thumb her nose at the Court.  Can't do that, boo.

While I agree that jailing someone for unpaid tolls is wrong, I also say there are other ways to get there. There have been times when I could not afford the extra expense of the tolls. I just took a different route to get there. It may have taken a little longer, but I also did not have any bills sent to me.

The best option would to be to stop make all the new roads in the area toll roads. Roads should be public domain and having to pay for them through tolls just adds more cost overall. Not only do we pay to have them built through tolls, we have to line someone else's pockets to for all the administrative fees. 


Apparently now we have them wasting our courts time and money prosecuting things like this instead of the real criminals..

Weir Bros Inc have a total of 11,100 violations, totaling 132,244.00 in fines and tolls.... so I would suggest jailing the CEO of that company or maybe any of the others that are continually in violation ... selective enforcement and, ohh, i dunno racially motivated? just sayin' ... get the real story at sunset the ntta on facebook.

Maybe time served will erase the debt, I know they'll do that for traffic infractions.

She can serve weekends, if it interferes with work. Courts aren't always total dicks.

Yes!  It's out of hand, especially when you are so often paying a toll to sit in stop and go traffic -- the North Dallas Tollway is an excellent parking lot at rush hour.  At least on my drive home, I'm not paying extra to sit still. 

A toll road should be an auxilliary to another free highway, and one that flies along.  They should pay YOU if you are sitting still on a toll road.

You could have stopped after the first sentence, and I would still have agreed. How long till NTTA gets its own police force, and then how after that until they get a SWAT team with federally funded military gear, which they must absolutely use to justify more gear.

Some of these cases, like hers, apparently need a second-grade teacher experienced in remedial reading to communicate, along with police.

It's called deductive reasoning...the fines are unpaid even with numerous attempts to collect...debt got so big she doesn't have the money...

It's $14,000 freaking dollars...like all white, I have that in my handbag...

@bvckvs @northtexasfossilguy  the People did not charge her, the false entity created in their name by unconstitutional statutory law (that is significantly, grossly, and completely counter to the intention of any of the founders or the longstanding tradition of free and open roads in this country), and her unknowingly entering into a contract via her drivers license, her lack of an appearance in court, and her lack of a timely appeal was her downfall.  In short, she didn't know how the system was rigged and how everyone is being misled, maliciously I might add, into believing it is legitimate, when it is an outright fraud against the People and the natural rights of the People to free movement when not operating as a commercial carrier in the first place, and that she has no duty or necessity to pay the toll, which should not exist in the first place, because it is illegitimate.
