Failed Senate Candidate Chris Mapp Is Suing the DMN For Saying He Wants to Shoot "Wetbacks" on Sight

Last month we introduced you to Chris Mapp, a U.S. Senate hopeful from South Texas who would go on to be crushed by John Cornyn in yesterday's Republican primary. He's the guy who referred to illegal immigrants as "wetbacks" and said that ranchers should be allowed to shoot them on sight.

That's at least what The Dallas Morning News reported in its endorsement of Cornyn: "South Texas businessman Chris Mapp, 53, told this editorial board that ranchers should be allowed to shoot on sight anyone illegally crossing the border on to their land."

Mapp claims he never said anything of the sort and is now suing the newspaper for defamation.

The DMN will presumably stand by its report and presumably has documentation of the interview; editorial board editor Keven Ann Willey has not yet responded to an email seeking comment. (Willey's reply: "Yes re standing behind and yes re a record.")

In Mapp's version of events, he told the ed board, "We can't have illegal immigrants, drug cartels, human traffickers or terrorists coming across our border. Our borders can either be respected by choice or force, and so far choice hasn't worked."

The Morning News twisted his words, and it did so maliciously with "the full expectation that other news agencies would pick up this publication and further sensationalize it." The Observer is name-checked as an example, as is Fox News Latino, Huffington Post and Wonkette.

The result? Mapp says his reputation has been irreparably damaged, and he has become the target of numerous death threats, delivered in emails and Internet comments, such as:

-"I hope you die a slow death";

-"'wetbacks' shoot his a** when you see him!!", "yeah I would like to shoot u....";

-"This guy is scum. Shoot all dumbf*cks like him on sight!";

-"I'm going to his house at night and wait for him to come out and I'm going to shoot
him right in the forehead lol"; and

-"Let's Be-head him like El Chapo would".

To be clear, Mapp isn't disputing his repeated use of the term "wetback." In the suit, he quotes himself as saying it to the editorial board. But he told the San Antonio Express-News on election day that he'll never use it again. Promise.

Wetbacks can mean middle easterners, Germans, or Mexicans that are entering the country illegally by swimming the Rio Grand.  How many have been killed by these illegals on the border?  How many have been raped?  How many have been brutalized?  If you live down on the border, no matter what the color of your skin, the illegals are often called wetbacks, even by Hispanics.  And if you haven't experienced the violence of the border, it might be best to avoid extreme judgements.

This guy can join Paula Dean, but in the greater sense, how about the suggestion that a rancher should, or has the right to, shoot trespassers? Is this not legal in Texas?

If not, do the signs warning that trespassers "will be shot" constitute a legally actionable threat, along the lines of brandishing?

Anyone interviewed by any media who doesn't record the interview is just nuts. The same is true of the reverse.

Same reason I urge folks to record traffic stops, and install a dashcam. It's a dangerous world out there when the use of one word can get you killed or worse.

@ruddski  No, you cannot use deadly force unless you are in reasonable fear of bodily injury or to prevent specific crimes, which do not include trespassing.  


A stranger just trying to cross empty ranchland who is doing his damndest to avoid you usually won't satisfy the requirements for self defense.

@svivar9087 Unfortunately, you have just displayed an amazing lack of knowledge concerning illegals.  First, almost as soon as they arrive, other illegals, and some criminal citizens, sell them various types of identification papers.  There are still ways to get a birth certificate.  And the illegals do this.

Only the newest illegals work at menial jobs.  They have ambition.  So you'll find illegals TEACHING SCHOOL in some cases.  You will find them working as foremen and supervisors.  They have even been caught working as law enforcement officers.

Now, you need to wake up and see what is happening around you.  You know all those lawn companies mowing grass?  Yes, some employ illegals.  But what you fail to see, or refuse to see, is that a large number of those companies are OWNED by illegals!  Home remodeling, carpet installation businesses, construction subcontracting businesses, plumbers....a HUGE number of them are owned by illegals!  Just go ask small business owners what is happening to their bottom line due to these wetback owned businesses!  These guys cheat on their taxes at phenomenal levels.  They run up big credit tabs, then change their business name and disappear. 

You really are out of touch with the real world.  All you see is the pablum spoon fed to you by a complicit media.

It is my understanding that if the property boundary is properly marked, a landowner may forcibly eject a trespasser.  However, the landowner must give the trespasser the opportunity to leave by the most direct route out of the property.  If the trespasser is only crossing the property, it is only a misdemeanor.  If the trespasser is committing another offense against the landowner (such as destruction of property, burglary, vandalism) then the trespass rises to a criminal (or felony) offense.


Typically, when local law enforcement is called on a simple trespass, a warning citation is given and the trespasser is escorted from the property.  The significance of the warning citation is that on a subsequent trespasses, the trespasser will be arrested for trespass.


My opinion is that you would be on very thin grounds to shoot a trespasser for simple trespass.  It is my understanding that there needs to be an element of threat to your life before you can do so.


It is my understanding that when a landowner orders a trespasser to leave and the trespasser refuses to comply, the landowner may use force, but only necessary force, to eject the trespasser.


Any way that is my experience and what I have learned over the years from law enforcement concerning trespass.
