Michael Schmidt, Uptown Lawyer Shot By Police, Had Drugs, Penis-Shaped Marijuana Pipe in His Home

There hasn't been a satisfying explanation as to why Michael Schmidt, a successful Dallas trial lawyer described by friends as a "good, good person," barricaded himself in an Uptown apartment complex and opened fire on police while his 11-year-old daughter sat in his apartment. Probably, there never will be. But a list of the items found in Schmidt's home obtained by WFAA offers ... clues? Red herrings? A voyeuristic glimpse of an unsettled life?

According to an affidavit, detectives found some normal stuff -- paperwork, iPads, an omega 3 supplement -- and some stuff that wasn't so run-of-the-mill. Among the contents of a safe in Schmidt's apartment were:

  • a clear plastic baggie containing a white powdery substance;
  • a clear plastic baggie containing a green leafy substance;
  • multiple baggies and bottles containing pills of various colors;
  • 10 Texas driver's licenses; and
  • a penis-shaped marijuana pipe.
  • various ammunition that will be compared with shell casings from the scene of Schmidt's shootout with police.

It doesn't take a forensic scientist to deduce the white powdery and green leafy substances might be. Weaving those into a coherent narrative explaining Schmidt's apparent suicide-by-cop will be considerably more difficult.

What is the purpose of releasing piece-meal but salacious facts before the investigation is concluded?  What would motivate the Police to do this?  Spin control.

It appears somebody wants the public to form an opinion influenced by the sequential release of facts in a certain order.  What's the hurry?

I am more interested in the facts surrounding the gun battle.  It appears that it was a righteous shoot but the release of the above stupid shit found in a safe, that may or may not have been his stuff, at first blush looks like misdirection.  Why would they do that?  What is the compelling reason to put this out?  The guy's dead.  He's no threat so why the rush to out this guy?

Why, this guy had it coming to him, right?  Obviously a sex addict (KY jelly), on drugs (pills), liked marijuana and probably gay ("penis shaped"? really? think about that description), lied about a 911 burglary in order to take on the cops in a gun battle (manly gay I suppose), wouldn't put his weapon down then continued to fire so we had to put HIM down with massive suppression fire.

his little girl was in his apartment.

he had no history of anger, mental condition, or propensity to engage in a futile gun battle with the cops.  Seems out of character but maybe he "snapped"?

I am not ready yet to conclude he "had it coming to him" by virtue of what was found in safe that may or may not have been his stuff.

It is not matching up with his life.  Of course, he ain't around to defend himself.

It was probably a redneck who wrote "penis shaped pot pipe" cause it was probably just one of those glass ones that get wider at the end. But thanks to needing headlines this guy will go down in history as the penis shaped pot guy. 
But then again.... it's not like there was a positive spin to put on this. So Penis shaped pot guy it is.

That list in the affidavit shows a person who was using A LOT of meds for depression and anxiety, coupled with the possibility of cocaine and whatever the rest of the drugs of varied colors were in the baggies....little possibility he was in the real world if he mixed them up.

a good question is what the daughter's mom knew about his chemical issues, and if she knew why she allowed the daughter to ever stay with the dad.

As reported elsewhere, the daughter was not in the apartment when all this went down. This "good, good person" took her downstairs with him to the front desk to report the burglary.

The affidavit is public record, and give a better picture of this man's circumstances leading up to the shoutout. The conclusions drawn are yours.

The girl was not in the apartment. Schmidt took her downstairs with him, while armed, then reported a false burglary in order to ambush the cops with his daughter present. He fired the first shots at policemen with bystanders present.

Whatever the motivating factors may have been, a full accounting is needed, including what could have led this "good, good person" to hoard drugs and ammunition in a family apartment complex, and to then stage such an elaborate and ill-fated showdown, mortally endangering himself, his daughter, innocent bystanders and responding police officers.

I see no rush to judgement here, and it's no slur on the man's memory to simply account for his possessions as of the night of the incident.

Life is a rorscharsh test.  Some will see the drugs as the focus, some will see the little girl as the focus, some will see the zip code as the focus, etc., etc.


If you are focused on the penis pipe, it's not because the media made it so.

@mavdog I'm also curious about the neighbors who were interviewed by reporters on camera.  There were several who shyly said they knew the lawyer "had problems" and then shut themselves up real quick and practically ran away from the reporters.

I kinda think that whole apartment building is just one big crack house - for rich white people.

yet when the police shoot a person who is not only armed but is shooting at them it's "murder" in your world.

Did the detectives in charge of this case tell you this?  What is their report say?  Are they talking while they investigate?  Why not?

You're quite right. The reported facts do not in fact square with what his friends and associates are saying. We should indeed be skeptical of all sources until more is known. In the meantime, let's also not ignore the realities of what happened just because the fellow gave few outward signs that any of this was coming.

One reason why I question the other "facts". Does a crack or Maryjane pipe need such a descriptor when introduced as evidence or can the pipe . . . stand on its own when introduced?

and what "facts" have been left out?

And what is your conclusions based upon the distributed and selective "fact" stream?

And once you form your opinion, can there be any evidence (not facts, a big difference) that may cause you to say you were wrong once you verbalize your opinion?

All I am saying is, some of these "facts" aren't squaring with the dead guy's life, and what his friends and associates are saying.

I am questioning the sequence of release of selective evidence.

It looks like there is a push to influence your opinion and it also looks like its working.

So take a breath.  Be skeptical.

@mavdog He showed his violent criminality when he shot at the cops.  If it turns out that the cops made that up, then he's not a violent criminal and the cops are murderers, but I doubt that is the case.

to be accurate, you  profess that you are not now nor have been a "violent criminal".

the same could have be said about Michael Schmidt for all that we currently know.

as for if you could be a "violent criminal" in the future, and there might be a need for the police to act such as they did with Schmidt, impossible to say with certainty. it's possible.... 

and if that were the case it would not be "murder" if they killed you, just as it is not "murder" in the case of Michael Schmidt.

He wasn't a criminal defense lawyer - although he did sometimes tell people that.

His main work was in administering a "charity" for the victims of the explosion in West.
