Judge Orders Marlise Munoz to Be Taken Off Life Support

Finally, after nearly two months being kept on life support, Marlise Munoz will be allowed to die.

Just after 4:15 p.m., a Tarrant County Judge sided with Munoz' family, declaring her legally dead and ordering her removed from support.

The decision came after less than an hour of debate. Fort Worth's JPS Hospital, which was being represented by the Tarrant County District Attorney's Office, argued that they have an interest in protecting Munoz fetus, now 22 weeks. Attorneys for the Munoz family said the hospital was conducting a "science experiment."

Under the judge's order, JPS must remove Munoz from life support no later than 5 p.m. Monday. Amy Silverstein is at the hearing and will follow up with a more detailed account later.

It's done.  In spite of Ft. Worth's Republicans' best efforts, the family will now be able to bury their dead relative.

The next step in this process should be for the doctors to be charged with abuse of a corpse and lose their licenses.  If they argue that they honestly believed she was alive, then the criminal charges should be dropped, and civil charges of malpractice should be pressed.

Either way, these doctors should not be allowed to continue to practice medicine.

Curious at the times the Conservative Tea Patriots decide when the Government SHOULD be involved in our lives and when they SHOULD not. 


It is amazing how right wingers can show so much love to a fetus up to 9 months but once that fetus becomes an actual baby, they seem to run in the other direction and their only concern is that the child does NOT receive any free $$ for food, education, or health care.  And that Mother (who they demanded have this child) better have a husband (Male) and be wealthy or have total job security.  


My heart breaks for this man and for the added misery put upon him.

JPS acted abominably. They forced a stilted interpretation of the law--every expert opinion I have read from attorneys and bioethicists stated the law did not apply to dead former patients--on a grieving family.

They espoused the canard they needed judicial assistance; a plain lie as they failed to seek a judicial ruling when their conundrum first arose on November.

I hope they pay millions to the Munoz family. They ignored the family's wishes and unilaterally turned Mrs. Munoz' body into a cadaver for a seriously injured fetus.

She is already dead, they are allowing the fetus to now die due to the wishes of the family.  They can finally grieve

JPS has taken the position that their hands were tied, they must follow the law.

now, with this Judge's ruling, they have the legal avenue in front of them to grant the family's wishes.

If JPS appeals this order they will be showing the statement they had no choice but to keep the woman breathing was a ruse.

I wonder what they will do...

@bvckvs this was never about if Marlise was dead or alive, it was about removing life support from a woman with a fetus inside.  JPS got the court ruling they wanted to clarify the interpretation of the law.  And as you know, they didnt appeal when the ruling came down so why you want to crucify the doctors is insane

@mavdog according to WFAA, JPS told the court today the fetus was not viable.  I doubt the appeal based on that.

The fact that the doctors needed a judge to tell them what the proper medical protocol should be is proof that the doctors were not competent.

Doctors know that you can't provide "life support" to a dead person - so calling what they did to her corpse "life support" wasn't just incompetent, it was dishonest.

The doctors didn't have to follow the bad advice of their lawyers.  They chose to.

Beyond that, there's no medical protocol requiring doctors to consult their lawyers on what to do.  That was a choice they made.

Blaming your choices on bad advice from your lawyers is not a legitimate defense for abusing a corpse.

@bvckvs@ScottsMerkin I don't know if its so much the Doctors , I think its Lawyers who don't have a medical degree telling the doctors what to do. I cant imagine many people in the medical industry thinking this was a good idea.

There is and was no law requiring the doctors to use the dead body as an incubator for the fetus.

In fact, doing so is a serious crime - "abuse of a corpse".

That's why I think the doctors should be prosecuted.  Not just for what they did, but as an example for other doctors who would substitute their religious beliefs for our laws.

@bvckvs right so, the doc who knows the law exists ignores the law, takes her off and then the state comes after the hospital and the doctors for not only their licenses but everything they own.  you keep forgetting that small little piece of the puzzle known as the fetus
