After Another All-Night Fight, the Texas House Passes Some of the Nation's Toughest Abortion Restrictions

For the second time in three days, Democrats put up an epic, all-night fight against proposed abortion restrictions in Texas.

This time, they lost.

Republicans railroaded the legislation through the House of Representatives on a 97-33 vote right around 3 o'clock this morning after Democratic lawmakers' 15 hours of impassioned testimony/procedural jiu jitsu was cut short by a vote to stop taking amendments.

"This bill will ensure that women are given the highest standard of health care in a very vulnerable time in their life," Representative Jodie Laubenberg, the Parker Republican who shepherded the measure through the House, said just before the vote. "Sadly, too often today the back alley abortion is the abortion clinic because the standards for the providers and the facilities are too lax or substandard."

Her proposal would ban abortion after the 20th week of pregnancy and require clinics to meet the standards of ambulatory surgical centers, a move that is medically unnecessary and opposed by reality-based groups like the Texas Medical Association, the Texas Hospital Association and the American Congress of Obstetricians and Gynecologists. The practical effect of the measure would be to shut down 37 of the state's 42 abortion providers.

The irony in all this was not lost on the 800 or so protestors who packed the state Capitol, nor was it lost on Senator Senfronia Thompson, a Houston Democrat who angrily wielded a coat hanger to illustrate the likely affect of the cuts on women and likened the bill to Sharia law. She attempted to add an exception to the 20-week ban in cases of rape and incest, but the measure was tabled.

Laubenberg explained: "In the emergency room they have what's called rape kits where a woman can get cleaned out. The woman had five months to make that decision, at this point we are looking at a baby that is very far along in its development."

The Associated Press describes this simply as "not accurate."

The bill now goes back to the Senate, which has until the end of the special session at midnight on Tuesday to consider the measure. Dems haven't yet given up, but a Republican victory is more or less assured -- in the short-term at least.

"Women are not going to tolerate the constant chipping away of their rights, we are not going to be bullied," Thompson said before the vote. "We are soldiers in the army of women's rights, and while today we may be outnumbered and out gunned, our cause is just and we shall prevail."

Why would republicans want to increase the number of minorities like this? They are always bitching about too many blacks and "mex'cans", but those two groups produce the most under-aged mothers. The answer is that no one really gives a crap about the mothers, children, or neighborhoods involved.

This is what the Founders wanted.  The States are given the powers not specifically granted to the Federal Government.  If one State has restrictive Abortion laws, the people can vote with their feet and move to a state with less restrictive laws.

The Negro Project wasn't designed to "exterminate the Negro population", the goal was the same for blacks as for others: educate about contraceptives so parents can decide the best size of their family and how many children they can financially support.

@madmarvin52 They aren't forcing anyone to have a child they don't want. They are wanting to  limit people who abuse abortion as a means of birth control's access to this service. They, rightfully so, expect anyone who participates in "adult activities" to be responsible.  If the left actually cared, they'd preach more about abstinence and condoms to stop the spread of HPV and other STD's; am I the only one who still remembers AIDS for fucks sake?  IF they cared, that would be their position, but they don't.

Of course there are two ways to apply the 10th to this argument: Is it the state's power to legislate this, or is this a person's right to choose?  I tend to always err on the side of the People, so I support a woman's right to choose, even if I disagree with her decision.

@Threeboys Another thought- am reminded of former TEA party Rep Joe Walsh of north Illinois who was vehemently against any choice for a woman what so ever.   He was so adamant about it that the did not pay child support for his children (divorced).  He was the only (in recent memory) member of congress to have his wages garnished for child support.  What a guy.

it's now a question of how long it takes for an abortion opponent to interject the story of Gosnell (or "goslin" in phelps speak). tell us, how would ASC requirements prevent another Gosnell? It wasn't his facility that produced the horror, it was the doctor, and he could have done his work in an ASC compliant facility....yes, more deceit.

but then at this point what else should we expect but more of the same?

Oh, no deceit. This one really is a giant fight about technicalities. ASCs actually are a good idea on this one (the goslin affair seems to be how we actually are treating poor black women seeking abortions, and this sort of barrier to entry is the only thing that will prevent that predation, on TOP of being a medically sound precaution) and the longer a woman waits to get an abortion, the less sound that decision is likely to be (and the more likely they are the victim of a pimp or abusive handler forcing them into it.)

This really is the least offensive thing they could do about the subject, and you SHOULD be applauding it, but instead you are losing your shit because the organ grinder turned the crank and you have the discernment if a trained monkey.

as eugenics is not "to rid the population of the lower classes", your premise is invalid at it core. I expect that most everyone today finds eugenics "disturbing". during the latter part of the 19th century it was a very popular idea tho, and most of the "educated class" subscribed to it.

the "real reason" for planned parenthood? to promote education of reproduction and to provide information and access to contraceptives.

margaret sanger was against abortion, saw it as dangerous and, if contraception was available, avoidable.

think about it, if more women were educated on contraception, how to properly use it, there would be fewer unintended pregnancies. fewer abortions.

the anti-abortion crowd should be out there supporting planned parenthood's mission to educate and provide contraceptives, but alas they can't see the forest for the trees...

@primi_timpano I don't know of any books or published  articles that deal extensively with the 10th amendment's application to states and to people.  My own view on it is based on reading other writings by founding fathers, court decisions, Blackstone's "On Law and Man", and various other writings that deal with citizen sovereignty.

RT, my only point was that while the 10th did reserve rights to the states, the 14th applied the federally granted constitutional rights, principally the first ten amendments, to the states, as well. I have never given thought to the 10th amendment issues you bring up, namely that the grant is to the States or the People. Do you know of any interesting books/articles on this subject?

I still don't understand why the fiscally conservative Republicans are so willing to spend money passing and eventually defending, a law that is patently unconstitutional. Those federal court legal bills get pretty large.

I would bet her age (13?) and the circumstances (rape, incest?, life threatening complications) might cause you to rethink your conclusion, and even if you still maintain it, that certainly does not mean these issues may cause other families to make different decisions.
