Police: SMU Student Was Assaulted and "Held Against His Will" at a Frat House Last Night [Updated]

From SMU's crime logs, we bring you a brief, somewhat disturbing, deeply weird police report: at 8:18 last night, campus police reported that a student was "was assaulted and held against his will" at the university's Sigma Phi Epsilon house. The case is being classified as "Aggravated Assault/Aggravated Kidnapping/Personal Hazing Offense/Unlawful Restraint."

Sigma Phi is also the house where 19-year-old sophomore John David Mahaffey is accused of forcing another student to perform oral sex. Mahaffey has reportedly been suspended from the frat pending the outcome of that case.

We don't know much yet about the alleged assault; whoever was answering the phones at the SMU Police Department said only that "all of our information goes through News and Information." That sounds like a riddle, but really it was a polite yet firm invitation to call SMU's media department. The media folks, in turn, hadn't heard about the incident, but said they'd look into it. We'll update accordingly.

What we do know: there may have been a frat party at SMU last night, as evidenced by this tweet from a student. "Woo hoo SMU frat party, wazzzzam," it reads poetically. But was the party at Sigma Phi? Did it in fact merrit a "wazzzam"? Wasn't rush week last month or something? Are these damn kids still hazing each other?

So many questions. The crime logs say the case is under investigation by the SMU police; we have a call in to the media folks and will update as soon as we hear back.

Update, 1:20 p.m.: SMU spokesperson Kent Best sends over this statement:

SMU takes seriously any allegations of student misconduct. SMU Police are vigorously investigating this case. Pending results of the investigation, SMU has placed the Sigma Phi Epsilon Fraternity chapter on temporary deferred suspension, which prohibits the chapter from hosting any activities, among other sanctions. Because it is an active investigation, no other information is available at this time.

Normally I would be satisfied the police were on the case, but are the SMU police real police, and if so, are they capable of handling a case like this, and to whom do they report? The dean, the HP DA, or the county DA?

A LXA pledge was painting the door of the Sig Ep house as a prank. The Sig Ep's caught him and took him inside and basically tortured him for 4 hours. They dropped water bottles from head height onto his balls and paddled him in the balls. They burned him and beat him up. There were 10 guys including pledges and actives.  They dropped him on the porch of the LXA house the next morning.

Ya um, I'm assuming you were never in a frtaternity. Outside of the oral sex, none of that is uncommon. Hell, go to Denton and it gets a lot worse.

@primi_timpano Interesting point.... the Dallas Morning News is currently raising this very issue with respect to the Parkland Hospital Police Dept.  Yes, they are real police, and to the extent their loyalties are with their employer (Parkland or SMU, as the case may be), they can effectively create a zone of semi-lawlessness-- wherein the "overlay" police department (DPD for Parkland or University Park PD for SMU) appear to cede authority.  It then it is up to these small "specialized" departments to determine what laws to enforce (or not) and how to apply the law.  To the extent they file complaints, those go to the Dallas County DA.

@primi_timpano Are SMU police real police? Technically yes, but you really wont catch them doing anything except handing out drug and alcohol violations to students. Which is funny considering how SMU is covered by SMU PD, Highland Park PD, University Park PD, and Dallas PD and yet they still never manage to catch any burglaries that happen on this tiny campus.

@WylieH @primi_timpano So can my condo association get a police department? Our condo borders are at least as definable as SMU's and I would be pleased for the association to establish a zone of lawlessness. Campus police are fine for closing down the frat parties when they get too loud, rousting the vagrants and HP peeping toms, but trying to cloak rape, assault and generally any felony from the real legal system (as opposed to the students courts and internal disciplinary systems) does the school, the victims, and the students a disservice and exiles them justice.

@primi_timpano if no one from your condos calls police, you will indeed have such a realm.  If your condo agrees to some security they become the first responders, and their willingness/reluctance to contact outside authorities will determine when outsiders are introduced.
