State Rep. Eric Johnson Filed a Bill Yesterday to Overturn the State's Voter ID Law [Updated]

Texas' voter ID law wasn't in effect for last November's election thanks to an order by a federal appeals court, but it remains on the books of the state's election code. (A refresher: Anyone who shows up to vote must present a photo ID. Handgun permits are okay; school IDs are not. Otherwise, they cast a provisional ballot).

Texas, citing a need to combat the virtually non-existent problem of in-person voter fraud, has appealed the appeals court's ruling and hopes for a hearing before the U.S. Supreme Court. In the meantime, State Rep. Eric Johnson of Dallas is pushing to make the state's legal battle moot.

Yesterday afternoon, Johnson filed HB 465, a bill that would do away with the voter ID provisions passed by the legislature in 2011. Under his proposal, any voter who presents their voter registration card will be allowed to vote, no questions asked. Furthermore, anyone on a precinct's list of registered voters can cast a ballot without the card so long as they fill out an affidavit swearing that they are to they say they are.

The bill would also reduce the punishment for those caught casting illegal ballots, from a second-degree felony (things like aggravated assault and intoxication manslaughter generally falls into this category) to a third-degree felony (i.e. third-offense DWI and aggravated perjury).

"The ability to cast a ballot is a fundamental right that has come under attack in the last few years," Johnson said in a press release. "I have filed legislation that seeks to reverse this trend in order to protect the rights of all voters, while at the same time making the process more welcoming in hopes of increasing participation."

Johnson filed a slew of other bills, too. One would allow voters to register on election day, and would require polling places to have two registrars on hand for that purpose. Another would extend early voting hours. Yet another would make election days a state holiday, right up there with "Confederate Heroes' Day" and December 26. A final one would require that criminals who are eligible to vote are provided with voter registration forms upon their release from incarceration.

Few of these -- the voter ID repeal in particular -- have more than a snowball's chance in hell of passing the ultra-conservative Texas legislature. But it can't hurt to try, right?

Update at 1:40 p.m.: Johnson thinks the bills have more than a snowball's chance of passing. Or maybe it's more accurate to say that it's too early to predict the exact temperature of hell.

"It's a different legislature than it was last time," he says. "I don't know what the reception will be from all these new members."

Returning members, too, might want "to wipe the slate the clean" and start thinking of ways that make it easier, not harder, to vote, which Johnson says is his goal. "To me the ability to participate in the process is sort of the basis from which all other issues flow," he says.

In other words, the legislature can only truly represent the public interest when the public is voting. As it stands, a large percentage isn't.

That said, Johnson says he is open to a bill that would tighten rules on absentee ballots, which he says yields "the real voter fraud out there."

How about a law that says every single person paid in a political campaign must be paid with a check or bank action and provide a real social security number. I think that Rep Johnson means well but it does have its drawbacks.  For example, my daughter signed up for voting when she needed to get a replacement state ID card.  A week later we received four voter registration cards for her on the same day.  So, in theory, she could vote four times in the next election.

A 27-year-old Wilmer man was charged Tuesday with cruelty to an animal after Mobile County sheriff's deputies said he sexually abused a miniature horse in Wilmer last weekend.

Eric Steven Easley was also charged with killing or disabling livestock, which spokeswoman Lori Myles said is a felony.

She added that those two charges were filed against Easley because Alabama has no specific provision in its sexual abuse laws to cover bestiality.

Suspect in elderly woman's rape previously arrested 52 times

The man accused of raping an 83-year-old woman in Marrero Sunday has been arrested at least 52 times in the past, in 10 different jurisdictions. And sheriff's deputies say 51-year-old Kenneth Adams had only recently gotten out of jail.

VIRGINIA BEACH, Va (WAVY) - A Virginia Beach woman in her 80s was attacked Sunday night in her home located in the 3400 block of Sale Drive.

Virginia Beach police tell that the suspect raped her, then asked for money.

The suspect is described as a black male, 18-20 years old with medium build, about 5-foot-9 or 10 inches, wearing all black. The victim was watching television at about 10:30 p.m. when she got up to go down the hallway. That's when police say the suspect grabbed her.

"He confronts her, he grabs her, takes her into a room and sexually assaults her," said Adam Bernstein, a Virginia Beach police spokesman. "After the sexual assault he demanded money. She gave him a little bit of money and he fled on foot."


The house her late husband built more than 50 years ago felt like her protector. Inside, the widow told her family, she sensed his arms around her.

Then on Feb. 14, 2010, a stranger silently broke into that house and changed everything. The 88-year-old woman was headed down the hallway for bed when a man in dark clothes accosted her, forced her into her bedroom and sexually assaulted her.

It was the second such attack on an older Virginia Beach woman in just more than a year.

Rape of elderly women on the increase

On January 2, an 82-year-old woman was raped in the Northern Cape and a 73-year-old suffered the same fate in Limpopo.

The attacks came in the wake of a spate of attacks on the elderly in Limpopo and KwaZulu-Natal.

Yesterday, Northern Cape police spokesman Lieutenant Donald Mdhluli said a 49-year-old man had appeared in the Galeshewe Magistrate's Court for allegedly raping the 82-year-old grandmother on Wednesday last week.

The case was postponed to January 16.

Constable Moses Molepo, police spokesman for the Mankweng area in Limpopo, said the search was still on for the man who raped the 73-year-old at her home.

He said that last year, a man had been linked to the rape of three pensioners aged 60, 65 and 93.

Another man was to appear in court next month for the rape of a 75-year-old woman, Molepo said.

Last year, two women, aged 94 and 82, were raped in a village in KwaZulu-Natal.

Zubeda Dangor, executive director for the Nisaa Institute for Women's Development, said it believed rape of the elderly was on the increase.

Whether it is an older or younger woman, a child . why is it that we do not take a stand?" she said.


Suspect in elderly rape arrested

A 42-year-old Houston man is in police custody and is considered a suspect in the rape of an elderly female and an attack on a second elderly female, both residents of Cleveland Housing Authority’s Boothe Square where a total of 18 elderly residents live.

An alert, gun-wielding neighbor is being credited with helping police nab the suspect, Demetrius Donielle Jackson, following the second attack.

The first attack took place around 9 p.m. Dec. 20. The 69-year-old victim was raped by a heavyset, black male.


Suspect pleads not guilty to rape of elderly Kirkland woman

A 26-year-old man accused of violently attacking and raping an 80-year-old Kirkland woman on Oct. 25 pleaded not guilty during his arraignment today. But he will remain in custody until his next court date on Feb. 5.

Moses Kelly was charged with first-degree rape and first degree burglary in King County Superior Court on Dec. 27.

Redmond police arrested Moses Kelly on Dec. 26, who detectives believe is transient and his residence is currently unknown. They located Kelly near a gas station in Redmond and took him into custody on Kirkland’s felony warrant. The warrant was obtained when DNA evidence gathered from the October assault came back as a match to Kelly.

Kelly’s bail is still set at $1 million due to the “extraordinarily violent” manner in which he allegedly raped the woman, said Lisa Johnson, senior deputy prosecuting attorney, in charging documents filed on Thursday.


Slatington man gets prison for raping elderly North Whitehall Township woman

A Slatington man who prosecutors today called a serial rapist of elderly women was sentenced to 30 to 64 years in prison for sexually assaulting a 77-year-old North Whitehall Township woman.

John Anthony Vega, 29, who has also been accused of similar crimes against elderly women in Northampton and Carbon counties, must also register for life as a sexually violent predator.


Former Sac. officer accused of raping elderly woman

 SACRAMENTO, CA - A Sacramento police officer was arrested in connection to sexually assaulting an elderly woman multiple times while off duty.

Gary Baker, 49, was arrested Thursday and charged with rape, assault with intent to commit rape, forcible oral copulation (two counts), attempted forcible oral copulation, and sexual battery, Sacramento County District Attorney's Office spokesperson Shelly Orio said.
