The State Trooper Who Performed Roadside Cavity Search Was Suspended Yesterday

The Texas Department of Public Safety has been mostly quiet about the case of Angel and Ashley Dobbs, who were cavity searched by a state trooper during a July traffic stop. The agency released a statement late Tuesday saying only that the troopers' actions have been investigated and that the findings were passed along to a Dallas County District Attorney's office. The DA plans to take the information before a grand jury in January.

In the meantime Kelley Helleson, the trooper who performed the cavity search, has been suspended. DPS spokesman Tom Vinger told the Morning News last night that Helleson was placed on unpaid leave pending the outcome of the investigation.

Incidentally, I really am surprised that so far there haven't been any posts from LEOs claiming breathlessly that ANY scrutiny, ANY questioning of ANY LEO anywhere is a sure sign that you want the terrorists to win and that the next time you're in trouble, call a lawyer. Is this case just too egregious even for those reflexive defenders, or have they just given up on the Observer?

The worst news is that after a lengthy, public-paid investigation, she will be fired from DPS and end up in a less-accountable, less-visible police force where they will be glad to have "a proven veteran with your training and experience. Never mind what those namby-pamby, lawyer-loving criminals said, we'll always support you here in Redcollarville." And she'll be free to finger and abuse all she wants.

Wow ... about six months after the incident, a lawsuit being filed, and high media exposure ... and the DPS finally takes action?

I like the tepid statement that the DPS turned their investigation file over to the Dallas County DA.  So if I understand it correctly, both of these officers were on duty during the investigation?  What gives?

Did the DPS suspend the officer because of not following procedure or the because of the bad publicity?

@Myrna.Minkoff-Katz Myrna, the whole point is that it is never a good idea to resist anything when you are given an order by a police officer no matter how insane the order is.  If you show any kind of resistance, you can be arrested and taken to jail for at least 24 hours even if no charges are filed.

The only time that I will say no to any police officer is if they ask for my consent to search my vehicle.  The answer from me will always be no.  My car may be searched anyway but at least the officer will at some point will have to respond to a judge.

Is there a slang term to describe using the same finger (for the victims' sakes I hope it was just a single finger and not the full Mano) on both below-the-belt orifices? The officer needs some sex education, as while her move may have be "safe sex" with regard to the risks of pregnancy (I am guessing here, as the abstinence focused sex education curriculum of my Texas education surely never delved down into the ins and outs of physical descriptions), but certainly isn't safe in connection with the cross contamination of flora and fauna with excremental remnants.

@Myrna.Minkoff-Katz In the officer's defense, the alleged "assault" may not be legitimate assault as the ladies did not physically resist. A close inspection of the inspection seems to reveal some smiles and giggles by the affronted--and abacked--parties.

@GuitarPlayer did they have a choice, you start fighting it and then you get a resisting or assaulting an officer charge and then some crazed cop will come running up and drop on elbow on a subdued person.  Honestly I cant believe they could perform that kind of search without even arresting them much less out in an open area.  You get a more private less invasive searches in prison

True, and as in many instances, we are probably not getting the whole story.

I still don't see the need for anything but a pat down if the car was going to be searched due to the "I smell marijuana." statement.

It still comes across to me as "I am a police officer and you will do what I tell you to do regardless of whether or not you have any rights because I can arrest your ass and throw you in jail for at least 24 hours."

Sorry for the late reply gut my legitimate comment was intended to partially defuse my observation of the tape. Whether it caused pain, shame or shock, the search was unprovoked and lacked consent. A an illegitimate rape (not fighting like hell for life and limb, usually because the threat of force) is no less a crime than the legitimate rape, where the victim resists.

There is no reason for a cavity search on a street, whether the allegation is possession of contraband, murder, or speeding. I apologize for any implication a woman or man should be expected to refuse an order from a law officer, who is likely armed and in any case can place you in jail at his or her whim.

I wonder why no disciplinary actions were meted out to the male officer who was certainly aware of the assault being perpetrated in front if him.

@primi_timpano You know, I noticed that too. But my perception of it was that both women seem shocked and embarrassed, which leads to some nervous giggling. But I wouldn't say they don't seem upset.

"This has been an eye-opening experience for me," one of them tells an officer near the end of the video. "I've never been pulled over, never searched like this. I was like totally violated over there a few minutes ago. I had a finger in my ass and a finger in my pussy. This is so embarrassing to me." 

I don't think "legitimate" or "illegitimate" assault should be judged on the basis of whether or not they resisted, especially in a situation where it could have been very dangerous to do so.

Wow, ... the police have very wide discretionary powers when it comes to a traffic stop, unfortunately the side of the road is not the place to argue with a cop ...


Actually, the one thing that you can do, is to say no and ask for the LEO's supervisor ... if the LEO says no, then it will be caught on video


Do you remember the problem with DPD a few years ago when they arrested people for "resisting arrest" and it was the only charge?  They found out that you cannot arrest someone for resisting arrest, when they are not arrested for some other charge.


If they wanted to do a body cavity search on me for littering, then not only would I say no, but hell no.


The main point is that searching the inside of the clothing appears to be unwarranted and the DPS troopers had no probable cause to do so.
