Judge: Farmers Branch Voting System Robs Hispanics of Representation

A federal judge ruled Thursday that Farmers Branch's voting system is depriving the Latino population of representation on the City Council. City leaders have 60 days to address the violation of federal voting law.

Farmers Branch's ethnic history has been troubled over the last six years or so. The town has spent some $5 million in court defending a housing ordinance requiring renters to verify their lawful immigration status. Opponents of the ordinance, including a three-judge panel of a federal appeals court, say it targets Latinos, pointing to subsequent anti-Hispanic legislation and proposals from the town council.

U.S. District Judge Sidney Fitzwater considered the town's history of racially tinged politics in Thursday's order, including an English-only ordinance and the removal of Spanish-language channels from television at a local rec center. What's more, he noted that no Hispanic has ever been elected to the City Council. But it isn't as though they haven't tried. Hispanic candidates have run for seats every year between 2007 and 2011. Strong support from the Latino community could never overcome the overwhelmingly white voting bloc on the east side of town. That's because the Farmers Branch voting system works by sheer majority in an at-large place system, rather than through single-member districts.

It means the entire council could, theoretically, live on the same street. In fact, much of the council lives on the east side of town, near the Brookhaven Country Club and in the upscale Wooded Creek development. Expert testimony found that a series of hypothetical districts had an eligible voting population that was majority Hispanic.

Illegal Immigrant accused of rape in Franklin County

RED BAY, AL (WAFF)- An illegal immigrant is accused of rape in Franklin County.

Red Bay police arrested Francisco Toto Mejia on Monday. Police said he attacked a woman living in his apartment community.


Investigators said he raped the woman in August, but she was too afraid to come forward.

Mejia is in the Franklin County jail on $20,000 dollars bond.






Illegal immigrant charged with rape in Limestone County

LIMESTONE COUNTY, AL (WAFF) - Police arrested a man they say had a sexual relationship with an 11-year-old girl for more than a year.


23-year-old Juan Lopez Rios was charged with rape for the crime. Police also say he bit the 11-year-old victim on her chest.

Limestone County Sheriff Mike Blakely calls it a disturbing case of child rape that began over a year ago.

"They would meet, they had a neighbor or relative that had a van. They were meeting regularly," said Blakely

Investigators say the 11-year-old Hispanic girl was having consensual sex with Rios.

Blakely says the girl's mother discovered their relationship when she noticed several deep bite marks on the child's chest.

She filed a police report first thing on Monday morning.

"When he was arrested, he admitted she was 11-years-old, but he didn't know he would go to jail for it," said Blakely.

Rios, who is in this country illegally, was arrested and charged with first degree rape. Alabama law states the age of consent is 16.

Blakely says what disturbs him most isn't the age, but the brutality Rios showed the girl.

"That within itself constitutes a crime even if statutory rape had not occurred," said Blakely.




Sheriff's deputies arrest illegal alien rape suspect

Evidence returned from a state laboratory helped Houston County Sheriff’s investigators make an arrest in a nearly three-year-old child rape case.


Sheriff Andy Hughes confirmed that deputies arrested Alvaro Rayo Roblero, 31, of Gilley Road, Dothan, on Monday, and charged him with felony first-degree rape.

Court records indicate investigators charged Roblero with the rape of a 15-year-old Slocomb girl by force on June 22, 2008. Records indicate the victim was taken to Flowers Hospital for treatment after the sexual assault.

Investigator Rose Shirley said the arrest was made after investigators recently received information from the state Department of Forensic Sciences that helped them match Roblero to the case.

Roblero was taken to the Houston County Jail and held on a $60,000 bond. If convicted of the class A felony crime of first-degree rape, Roblero faces 10 to 99 years or life in prison.

Hughes said a hold has been placed on Roblero at the Houston County Jail by agents with the U.S. Immigration Customs Enforcement (ICE) because he’s an illegal alien.

A 5-year-old girl is undergoing treatment for possible HIV infection

after the man charged with raping her -- an illegal alien who was

previously deported to Mexico -- admitted he has the virus,

authorities said.

The case has re-energized some state lawmakers to push for tougher

penalties for people who commit sex crimes and knowingly expose their

victims to HIV, the virus that causes AIDS.

Julio Cesar Cruz Martinez, 32, of Fairhope is being held in a

segregated unit at the Baldwin County Corrections Center on charges of

first-degree rape, sexual abuse and sodomy, a jail official said


Police said Martinez has confessed to some of the acts involving the

girl and to knowing he had HIV before the crime reportedly occurred

Sept. 13.

Officers notified the family immediately after Martinez disclosed his

infection, sheriff's spokesman Lt. John Murphy said.

"The child has been taken to medical services, where she has been

tested and is being given treatment to reduce the risk of the HIV

virus," Murphy said Wednesday.

HIV is a virus that destroys the body's ability to fight off illness

and is the cause of AIDS. People infected with the virus do not have

AIDS until they develop serious symptoms, but they are capable of

transmitting the virus through sexual intercourse, according to the

AIDS.org Web site.

Martinez has undergone HIV testing at the corrections center to

confirm whether he has the virus, Murphy said. The lab results are

pending and may not be released publicly, he said.

Deputies had questioned Martinez's identity, since he did not provide

valid identification.


Temple Black, spokesman for U.S. Immigration and Customs Enforcement,

said Wednesday that Martinez is an illegal alien who has been deported

to Mexico at least once. The department placed an administrative hold

on Martinez -- requiring him to remain jailed -- after identifying him

by photo and fingerprints, Temple said.


If convicted of the rape and other charges, Martinez would serve his

sentence in the U.S. before being returned to Mexico, he said.


Baldwin County District Attorney Judy Newcomb said this week that her

office was looking into whether Martinez should face additional

charges for knowing he had the virus when he allegedly raped the girl.

Newcomb said such crimes typically fall under assault or endangerment

statutes, and she doubted that Alabama had a statute to enhance

charges against someone who knowingly exposed another to HIV or AIDS.

Many U.S. states have laws making it a separate crime for someone to

knowingly expose someone to the virus during a criminal act. But no

such legislation exists in Alabama, a researcher with the Secretary of

State's office confirmed Wednesday.

State Sen. Bradley Byrne, R-Montrose, said he agrees Alabama needs

laws that would make it a crime for someone to knowingly expose

another to the virus while committing a crime, particularly in cases

involving children. Byrne said he plans to push for tougher laws in

the next legislative session.

State Public Health Officer Don Williamson said Alabama needs tougher

laws to criminalize known HIV exposure, but lawmakers should be

careful not to dissuade people from getting tested for the disease.

"The known exposure of another party by somebody who is HIV infected,

without warning them or taking precautions, is immoral and

reprehensible. We need to figure a way to deal with that," Williamson


Lawmakers should be careful to create rehabilitative options for drug

addicts and others at high risk to HIV infection, so that get-tough

laws don't discourage them from getting tested, he said.

"For some people, ignorance of the law is an excuse," Williamson said.

"If they never find out they are infected then they can't be charged

with knowingly exposing somebody."

Illegal immigrant admits raping, killing Ala.woman; will reveal accomplice

The illegal immigrant who confessed to raping and killing an Alabama homecoming queen in a West Knoxville hotel room made a vow Thursday to expose his accomplice.


"That is a promise I make to the family (to) give them some peace," Valentino Vasquez Miranda said via an interpreter in Knox County Criminal Court.

Miranda admitted at a hearing Thursday that he used a master key to get inside a sleeping Jennifer Lee Hampton's hotel room at the Days Inn on Lovell Road and then raped and strangled her in September 2008.

As part of a plea deal approved by Judge Bob McGee, Miranda was sentenced to life with the possibility of parole after a mandatory 51-year prison term.

Hampton, 21, was in Knoxville to help train workers at a new Mama Blue's restaurant set to open here. Miranda and girlfriend Rosa Hernandez were living and working at the Days Inn as housekeepers.

Assistant District Attorney Kevin Allen told McGee that the attack on Hampton was a violent one, with guests in an adjoining room reporting a crash against her wall severe enough to shake items in their room. Hampton fought for her life, he said, evidenced by bits of Miranda's flesh under her fingernails.

"The cause of death was strangulation," he said.

Hampton's body was found a week later face-down in Melton Hill Lake near the Solway Bridge. It was Hernandez who led Knoxville Police Department Investigator Steve Still to Miranda after finding his blood-stained clothes, Allen said.

"He told Investigator Still he had a cut on his hand, and that's where all the blood came from," Allen said.

But DNA testing showed the blood belonged to Hampton, he said.

It was DNA testing, however, that led, in part, to Miranda's plea deal.

Allen said testing on Hampton's sweatpants revealed a mixture of three DNA profiles, two of which were from men. One sample matched Miranda's DNA. The other revealed an "unknown male contributor," which authorities suspect was an accomplice, he said. Allen said the Tennessee Bureau of Investigation could not rule out Hampton as a source of the third DNA sample, leaving to speculation whether there was a third suspect in the case.

The TBI compared the unknown DNA profiles to another illegal immigrant who worked with Miranda and Hernandez at the hotel but found no match.

Miranda's plea deal "requires the defendant to submit to a full debriefing, including the identification of (any) others possibly involved," Allen said.

McGee stressed Miranda's promise to serve up the identity of any accomplices as he considered whether to accept the plea deal, noting Miranda must "tell authorities what all went on and identify others involved."

"Do you understand?" McGee asked.

"Yes," Miranda answered.

At a hearing earlier this year, Allen signaled that his office might seek the death penalty in the case. But the Mexican consulate, acting on behalf of Miranda and his family, later questioned whether Miranda was 17 at the time of the slaying rather than the age of 20 as suggested by fake Social Security documents. Under Tennessee and federal law, juveniles cannot be put to death.

To avoid a battle over the issue, Knox County District Attorney General Randy Nichols declined to authorize what's known as a "death notice" to be filed against Miranda.

Spared death and a lifetime behind bars, Miranda still tarried several hours Thursday before inking his plea deal.

Hampton's mother, Cynthia Senn, said she was told Miranda did not want to face her daughter's loved ones. He relented shortly before a 1:30 p.m. deadline.

Attorney Eddie Daniel already won a civil settlement on behalf of the Hampton family from the Days Inn. The terms have been kept under wraps.

Warrants Issued For Arrest Of Man In Multiple Charlotte Rapes

CHARLOTTE, N.C. -- Authorities in Atlanta have a man in custody that is wanted in Charlotte in connection with several unsolved rapes that happened in Dilworth and east Charlotte.


Jose Rivera, 26, was arrested on burglary charges in Charlotte, and then sent to Atlanta where he is being held by Immigration and Customs Enforcement in order to be deported. His deportation is now on hold.


Rivera is accused of attacking three women between April 2004 and September 2005, twice in east Charlotte and once in Dilworth. Police said he talked his way into a victim's home, attacked another outside her apartment and -- wearing only red underwear -- grabbed a jogger who was running alone. The attacker used a weapon in each case.

Authorities said that by October 2005, they had DNA evidence linking the attacks but couldn't identify the attacker. It's unclear what evidence connects Rivera to the attacks, though he was convicted of receiving a stolen vehicle last year and he would have been required to submit a DNA sample as a felon.

Rivera, who's from Honduras, has been jailed at least eight times in Mecklenburg County since 2004, according to records. He was deported in November 2006, an Immigration and Customs Enforcement spokesman said.

Rivera faces 16 charges in the three attacks, 14 of which are felonies.

FB has an at-large council, meaning no districts, meaning no redistricting.  To be accurate your statement should read:  Democrats again calling redistricting, the only way they can defeat Republican voter suppression (although there was no mention of any suppression, just a much bigger white majority)

An internet web site caused a person's head to explode today, according to the medical examiner.


A 9-11 operator was on the phone with the individual when they heard a scream and then nothing but silence.


Although details are not complete at this time, it appears that the individual was a complete social outcast, and as a result was totally absorbed in lashing out on internet forums against their perceived antagonists and enemies such as "illegal immigrants" and "rapists". The individual would conjure up mythical situations where they would appear to be contributing to discussions on issues, when in fact they wre just adding irrational and unintelligible musings.


The end apparently occured when a moment of reality seems to have magically seeped into the individual's mind, at which time having the chance to read what they had written a spontaneous explosion resulted.


There doesn't appear to be any family of the deceased who have stepped forward, and as a social outcast no friends exist, either.


The County is determining what to do with the remains.

Farmers Branch is 45% Hispanic, and its electorate is 24% Hispanic (the balance would included children, as well as illegals). There are just under 30,000 residents. The city council comprises five members plus a mayor. Having them all elected at large is disenfranchisement, plain and simple.


@Daniel While I do not share the views of whiteguilt guy, the voting issue certainly at least involves illegal immigration; counts based upon the number of people present are flawed by their failure to take into account the number of people who are illegally present. An example would be something like this: let's say that Springton, USA has a population composed of 75% "white", 13% "Latino" and 12% "black". Seems like the "white" folks would stand a good chance of dominating the representation of the town, right? Now, let's suppose that when we drill down that 70% of the "whites" are not citizens of the US. Further, let's suppose that these foreign nationals are not even here legally and are, therefore, not even supposed to be present. How would that change the voting dynamic?

Dallas police arrest two men in rape of SMU student




DALLAS — Detectives from the Dallas Police Department's Sexual Assault Unit charged two men late Wednesday night in the kidnapping and rape of an SMU student athlete. Charges were announced at 9:35 p.m. Wednesday. Police filed aggravated sexual assault charges against Arturo Arevalo and Alfonso Zuniga, both 28. Police took them into custody late Tuesday afternoon, though investigators would not immediately reveal what led them to the men. Arevalo and Zuniga are suspected of kidnapping and raping a petite SMU student athlete as she left an off-campus party with friends early Saturday morning, December 5. DPD said charges are pending against a third suspect. Investigators have asked that photos of the two men not be broadcast or published until the victim can view a lineup on Thursday. Records show Arevalo and Zuniga are illegal immigrants. They're being held on $500,000 bond at the Dallas County Jail


Anti-death penalty myself, but I actually agree that rapists get scandalously light sentences. 


My original point was, this post has nothing to do with illegal aliens per se. It's about American citizens being disenfranchised because of their ethnic backgrounds. Nobody's arguing that illegal aliens should be allowed to vote -- at least I'm not, and nor is Brantley Hargrove.
