Court Drops Gypsy Tea Room Skinhead's Lesser of Two '05 Convictions

The 2004 summer night when David Cunniff took his two teen daughters to an Old 97's show at the Gypsy Tea Room rattled Deep Ellum to the core. How it all went down depends who you ask, but the end result left Cuniff bloodied and beaten to the point that friends and family questioned whether he would live.

His broken neck and bruised body came at the hands of Jesse Chaddock, known to associate with the skinhead gangs of the neighborhood. He's still in prison for engagement in organized criminal activity, though as of today, he can count on a release far sooner than he originally expected.

The Texas Court of Criminal Appeals published an opinion this morning dismissing his aggravated assault charge and agreeing with his claim that it constituted double jeopardy.

Engagement in organized criminal activity is a "greater-inclusive offense," according to the court's majority opinion. The charges for both offenses were identical, except that the greater offense included that Chaddock committed assault "as a member of a criminal street gang."

The Observer followed the case closely at the time, recounting the narrative from the night of the show to Cunniff's remarkable recovery and lingering pain.

The prosecutor at the time of the trial argued that Chaddock still associated with the Confederate Hammerskins, a white supremacist gang known for violence. Chaddock still had his racist tattoos. His attorney stuck with a different story -- it was all a bar fight gone awry, a commonplace spat with a rare and terrible outcome.

In the end, a jury convicted Chaddock of engagement of organized criminal activity and sentenced him to 19 years in prison. The following month, he pleaded guilty to aggravated assault, which came with another 10 years.

As of today's Court of Criminal Appeals decision, he's off the hook for a third of his original jail time, but he still has quite a few years left to serve.

I know this is late, but i just heard about this in my last letter from jesse yesterday. All of you are full of shit, trying to be part of a grand drama, that was manufactured, mostly by the observer. And courtney, you heard wrong. Jesse is a lean 250 of pure muscle now, and he earned an A.A. from a local college. Nobody's bitch by any stretch of the imagination. And no he's not going to get out any earlier, he already knows this. The fact that this erroneous propaganda is still being printed is proof of that. Great journalism observer, you gone to complete shit!

I am just a person that knows the connection between Scott, lil jesse and the EC. I would be more than happy to elaborate, but I have a feeling Scott would not want that to happen, now the just got back into the biz. Im sure Jim S would love to have a follow up story about this little matter if he knew the all connections.

Another controversial story involving Toby Shook and his prosecutorial methods. I found this section particularly interesting -  Due process is designed to protect defendants from a rush to judgment.  Purported white racists are just as vulnerable to sloppy investigation and overly aggressive prosecution as purported black thugs.  In both cases, criminal justice professionals reach a conclusion before all the evidence is in then twist the facts to support their pet theory.  Had Shannon Finley been a member of a prominent Paris family the authorities would have been much more circumspect.  Had Brandon McClelland been a highly respected businessman the DPS trooper who initially investigated the incident would have searched the death scene far more carefully. It is always a bad sign when prosecutors try a case in the papers.  Toby Shook didn’t get incriminating evidence from Finley’s truck but he made the press believe otherwise.  You can’t blame the media for reporting what they are told–that’s their job.  Shook was trying to job the system and civil rights folks like me let him get away with it. Activists who have spoken out against Mr. Shook’s decision to drop the charges need to re-think their position.  There is no case.http://friendsofjustice.wordpress.com/2009/06/08/a-cautionary-tale-for-civil-rights-activists/
