Judge: Texas Can Kick Planned Parenthood Out of the Women's Health Program

When we said yesterday Planned Parenthood could remain part of the Texas's Medicaid Women's Health Program "for now," we didn't know "now" would last less than 24 hours.

A Fifth Circuit appeals judge has overturned yesterday's preliminary injunction blocking Texas from kicking Planned Parenthood out of the WHP. In his ruling, Judge Jerry Smith granted Texas an emergency stay, saying in the meantime he'll examine whether the state has the right to deny funding to the non-profit.

For now (and we use those words with extreme caution this time), Texas will be allowed to enforce its new rule banning Planned Parenthood from the WHP. According to the Associated Press, Smith gave the eight Planned Parenthood affiliates in the case until 5 p.m. today to present new arguments in an opposition brief. This is like watching the worst game of pingpong ever.

I love the way that you poor gullible suckers are still falling for this artiface.  The seminar writers are really amateurs on this site.  I would LOVE for Planned Parenthood to take this further legally so that someone could look into their shady finances.  Ann richards daughter Clare is "CEO" and makes a HUGE salary.  All those non-working supervisors with no management or medical experience getting their ox gored. Yes Texas has Community Health Services and they are not suppose to turn anyone away, but they do. So before the state claims they will still help the women of Texas they need to look in to the services they are referring them too.

There are plenty of federally qualified health care clinics all over the State of Texas that will make sure that women get their needed health care. Google "Texas Community Health Centers" to get to the website for Texas Community Health Centers -- providing services for the uninsured and underserved. These health care centers are the safety net that was established over ten years ago. These center are required by law to provide health care on a sliding fee-scale. They cannot turn anyone away 'due to abbility to pay'.

After thinking about this it might not be all bad. If Planned Parenthood appeals this to the Supreme Court they (should) rule that it is unconstitutional then with any hope this nonsense can stop

We should not be surprised at this ruling made by Judge Jerry Smith.

   This ruling by Judge Jerry Smith may result in even more people becoming convinced that he does not adhere to the Code of Conduct. The fact that the Judge ruled so quickly and only gave the eight Planned Parenthood affiliates one day to respond to his ruling while he “examines whether the state has the right to deny funding…” leads one to question whether he intends to thoroughly research the issue and whether he can be considered an independent judge.

   The Code of Conduct for United States Judges states that“An independent and honorable judiciary is indispensable to justice in our society”. It also states that, “A judge shall disqualify himself or herself in a proceeding in which the judge’s impartiality might reasonably be questioned, including but not limited to instances in which: (a)the judge has a personal bias or prejudice concerning a party…”. Remember that this is the judge who called The Patient Protection and Affordable Care Act “Obamacare”, which seems to be a partisan remark. In April, Judge Smith ordered theDepartment of Justice submit a report explaining President Obama's views on judicial activism.

Honestly here why don't we do something like planned non parenthood. Being a conservative has little to do with. How about the general public have some accountability and if you handle your own business then the government does not have to do it for you.

The funds in question are not used for abortions, but in many cases for prenatal examinations and care. Which will now be less available. So kids and mothers will suffer. And taxpayers will pick up the tab at a much higher rate than if proper care was provided in the first place.

Best way to eliminate abortion, or at least curtail it?

Teach a decent, accurate sex ed curriculum.  Teach kids how not to get pregnant and not near as many of them will get pregnant.  Make birth control available extremely cheaply so that they can actually put these ideas into practice.

There are plenty of low-cost and free health care providers for women who don't promote abortion, which anyone can attest is an extremely controversial topic.  It is questionable, at best, to use taxpayer money to fund such a divisive practice.  In the meantime, PP is funding Texas clinics themselves - without the taxpayer funds!  Imagine that.  A private corporation conducting their business without a cash infusion from the state.

Abortion is a legal procedure, and by definition Constitutionally protected -- not in the document itself, of course, but upheld as such by the Supremes. Rick Perry's (self-serving, almost certainly bogus) religious beliefs don't trump the Constitution.

 I can tell from what you said you haven't ever seen one of those providers.  I wouldn't send anyone to those places.  Many are nasty, have the worst med school rejects for doctors and offer only the most base care possible after waiting in line for an entire day.  So before you spout your BS go check things out.  PP offers caring services in a clean environment.  Just because you believe Faux News doesn't mean what they say is true.  PP is not about abortion and should receive the same funding any other clinic does.  Stop shoving your religiously based ideaology down everyone else's throats.  Freedom of religion also means freedom FROM another person's religion.

"the worst med-school rejects for doctors".  Clearly you are grossly misinformed or just  too angry to think straight.  All physicians here and in all other states must meet strenuous minimum training (at least 5-6 years post college) and certification (testing-clinical) requirements in order to practice medicine and are under constant surveillance by a very aggresive medical board in this state.  So before you"spout YOUR BS "and lose your already fragile credibility,perhaps you should consider who you are offending with your thoughtless comments.
