In Federal Suit, Man Claims DPD Stormed His House For No Reason, Beat the Hell Out of Him

Every once in a while, amid the stacks of semi-literate, pro se habeas corpus petitions, trademark suits and product liability complaints, there comes a federal filing so disturbing, so completely awful, that it leaves the reader with nothing but questions.

This week, it's Danny Cantu v. The City of Dallas and a whole passel of named and unnamed police officers. According to the complaint, which made its way to Courthouse News yesterday, Cantu, a diesel mechanic, was making his lunch January 22, 2010, when he saw a few cops streaking across his yard. A deafening explosion shook the room as a flash bomb shot through the door. Nearly 20 officers crashed in.

"Get on the ground!" they allegedly ordered him. Cantu, according to the complaint, obliged and was zipcuffed. Inexplicably, the filing claims, the officers kicked and punched him until he was unconscious, lying in a pool of his own blood on the kitchen floor. Meanwhile, they searched his house and allegedly didn't find what they were after. Cantu's alleged butcher's bill: a broken orbital bone, a broken nose, a concussion, traumatic brain injury, a loss of vision in his left eye and loss of hearing in his left ear. According to his complaint, the "injuries required surgical intervention and caused significant scarring and disfigurement."

Cantu was arrested but never charged with a crime. Indeed, a search of county court records yielded no charges under that name. Dallas Police spokesman Kevin Janse told Unfair Park neither the raid nor the name rang a bell. Nobody from the City Attorney's office was available to comment. None of Cantu's attorneys -- there are three -- responded to many messages left for comment. And nobody answered calls placed to a number listed under Cantu's name.

He's seeking unspecified damages to compensate him for his medical bills, mental anguish and disfigurement, among other things

Now for a little unsubstantiated speculation: If the allegations in the lawsuit are true, did police hit the wrong address? Or did they hit the right address on wrong information?

If the parties don't settle this quietly and if we hear back from Cantu or his attorneys, we'll update accordingly.

Happens in Prescott & Prescott Valley, AZ all the time but then 9 months jail time with supposedly resisting arrest! Also, with being in jail, not getting surgery right away. Both Prescott Valley and Yavapai County cops are crooked, evil, and mean. They especially enjoy beating up pregnant women!

That's naming names -  enough to suggest that this was really the DPD and not a gang masquerading as cops. So why no record of this police action?

Things didn't go down as the plaintiff alleges? Fine, let's hear the DPD's side of the story.

You sympathize with cops using "excessive force"? Excessive force *by definition* is EXCESSIVE. Not right, in other words.

You sympathize with cops and the difficulties of the job they face? Nobody is forced to be a cop. If you can't handle the job, find another one.

So why do people choose to become cops? Why do people choose any career path? Something you are interested in, something you can do reasonably well, something that pays well. In the case of at least some cops, it is the right to wear a gun and a badge and terrorize people.

There is never a legitimate reason to violate the rights of private citizens.  If one cannot stand or does not have the stomach for police work, choose another career path.  A slippery slope is no where to stand.

i've had dallas county deputies climb over our locked gate/fence over a 'warrant' for someone i don't know who has never lived here. on complaining to internal affairs, i was told that this 'warrant' gave them the right to search my home regardless of the fact that the person named in the warrant was totally unknown to my wife and i, had never lived or been to our home, and regardless of our right to defend ourselves against home invasion. we don't lock our door, we lock our gate. climb over our fence and you are a suspected home invader/robber/rapist and you are a lawful target. apparently although we have a constitutional right against 'john doe warrants'  it's perfectly legal to come kick someoneds door down out of sheer incompetence.

Ever single person I knew growing up that became Cops were the ones everyone hated because they bullied kids smaller than them around and bully's after school have no one to pick on when the finish school, so they become Cops, and beat their wives and kids. Yes everyone of the kids I knew that became Cops were charged at least once for beating their spouses and yet they are still allowed to carry a Gun.

I used to feel similarly to you, but when my brother became a cop (south east dallas) he started telling me horror stories that you would not believe.  They are so shocking that I can't even describe them.  Let me put it this way, imagine the "wire" and make it ten times worse.  They happen almost every day, and the people in Dallas have no idea what is going on.  

The most tame story was my brother helping a 9 year old child whose parents were murdered in the grove (drug deal or something).  The boy found both his parents in the trailer van shot execution style in the back of the head. My brother had to take the kid to an orphanage and in the car ride began to explain to the boy (in spanish) that his life was going to be completely different from now on and that he couldn't be a child anymore. My brother tried to keep his composure the best he could.  He wanted to visit the child later in the orphanage but he wasn't allowed.

Anyway, I hate it when cops abuse their authority, but I know why they use "excessive" force.  They are in serious mortal danger whenever they head out on the job. Many officers ride solo and don't get the benefit of having a partner. I get a call from my brother every day telling me how he almost got shot/killed/ambushed etc.. It's only a matter of time before he tells me that he finally had to kill someone.  He is not looking forward to that day. 

I asked him once to write an anonymous blog about his stories, but he said that they are so specific that he would be found out pretty quickly based on arrest reports.

That does nothing to justify why they'd brutalize an unresisting person (assuming this lawsuit is correct), especially after they had him disabled (ziptied) and on the ground. How are they different from the bad guys when they do this?

My neighbors house got raided one time because it was the same color/build as my other neighbors house (the one they meant to raid). Could've been avoided by looking at the address lol. Then they told her that they didn't want to pay for her door that they had just broken.... She got her door and then some in the end.

I also have a brother in-law who is a Miami Dade swat officer, when he's not working for Blackwater in Afganistan. HE is a scary, messed up guy. I have spent my life living in South Florida as well as Houston. I clearly remember when the police were actually peace officers who actually tried to protect and serve. This guy is clearly a demented, delusional nutcase. I suspect he is ex-military, who has spent 3-4 tours in Iraq / Afganistan under extreme duress. This is the problem. Hey pig, this guy wasn't trying to kill anybody.  He was making his lunch.  These guys were nothing but common criminals.  He had every right under Castle law to shoot to kill as soon as they started to enter without clearly identifying themselves and producing a warrant.  Maybe they weren't even real cops?  It's pretty easy to impersonate a pig while committing a home invasion.  Aside from that...why do pigs think it's okay to brutalize someone for the non-violent, victimless, non-crime of putting drugs into their own body.  Again though...they found no drugs or anything else illegal.  One can only hope that every one of them and every pig like them gets exactly what they deserve down the road.

Cops should be held to the highest standard regardless of pay. You don't hear our military complaining about low pay or benefits and look what they put up with. Citizens and their government should simply put cameras on all cops full time and fire the ones who have so much testosterone that they can't conduct themselves in a professional manner becoming an officer.
