As Promised, Texas AG, Paul Clement Have Asked Supreme Court to Stay Court's New Maps

Yesterday we gave you the heads-up: Texas Attorney General Greg Abbott has brought in former U.S. Solicitor General Paul Clement to try to throw out what they claim are the federal court's "unlawful redistricting maps." And, right on cue, they've filed their emergency stays with the U.S. Supreme Court: All four docs filed with the court are now posted to the A.G.'s website, along with Abbott's insistence that it's "judicial activism at its worst for judges to draw redistricting maps of their own choosing despite no finding of wrongdoing by the State of Texas."

The biggest issue they appear to have is with U.S. District Judges Orlando Garcia and Xavier Rodriguez's interim House map, which Clement claims "is entirely a judicial creation with no regard for the lines drawn through the political process." Which is interesting, because even Fifth Circuit Judge Jerry Smith -- the third federal judge tasked with reviewing the maps -- noted in his dissent last week that "the Legislature created substantial population disparities in Dallas and Harris Counties in a manner that may raise concerns of racial or partisan gerrymandering in violation of Larios v. Cox." Smith, incidentally, was also critical of Garcia and Rodriguez's newly created District 107, a "a new coalition minority opportunity district" in Dallas County:
Even leaving aside the question whether courts can ever mandate minority "coalition" districts, the majority seems to draw this district merely because it can be drawn. But no such district is required under section 2, and the State's plan creates no retrogression under section 5. Thus, the majority's meddlings in Dallas County stem solely from the majority's policy preferences, which are not an appropriate justification for judicial action.
In his Senate stay, Clement writes that "the three-judge court's interim order as to the Senate map is less sweeping than the court's wholesale redrawing of the House map, but it suffers from the same fatal flaw: a willingness to redraw an election map without a finding of any substantial likelihood of a statutory or constitutional violation."

I dispute the 55% minority, especially if the illegal population is counted as it should be---illegal. The Illegal population should not be counted for Voting Districts at all.They are here illegally and SHOULD NOT BE AFFECTING POLICY.

ANY "jUDGE " WHO ATTEMPTS TO USE HIS AUTHORITY TO USURP THE RIGHTS OF THE LEGISLATURE SHOULD IMMEDIATELY BE DISBARRED FOR "PRETENDING TO BE A LEGISLATOR". ...WITH JAIL TIMEAND  an investigation in to these Judges for trying to attempt to do this---.who are their supporters...who gave them money for their campaigns etc....

this is going to get ugly. that word gerrymandering has stuck with me since 8th grade civics.  "illegal manipulation of congressional districts"... now we have to add illegals.. Lions, Tigers  and Bears.... OH MY!

REad Wikipedia on Census---and see if we are not systematically erasing the USA...What we need to be Very Prudent about is protecting our ASsets and this is done by making sure Illegal Populations are NOT BEING USED TO REPRESENT OUR VOTING DISTR

I don't understand why Hispanic Judges, Hispanic organizations LULAC, MALDEF, and the only two HIspanics in the Legislature refused to advocate drawing a Casa Linda, Pleasant Grove state representative seat.   I think it was  to protect incumbent in District 100 which should be an Hispanic House Seat.  With three to four Republican State reps retiring and Caraway running for higher office, this could have been the decade that we draw according to communities with common public policy interests and not incumbents. .The African American strength in the Inner City  South Oak Cliff District 110 is diluted with drawing  the Plesant Grove Hispanics (which should be in 107 or 100 and spliting the southern part the City of Mesquite which is an rural to urban development area. Mesquite should have been kept whole asa community of common public policy interests just like South Oak Cliff should have been kept whole in District 110. We'll keep trying at the court level.

The problem my friends is that incumbents draw for themselves whether they are drawn by the Democratic incumbents or the Republican incumbents.  I hope the Hispanics are not counting on the Dallas County blacks in the legislature to back them in Congressional 6 I hope they learned not to rely on blacks after Atkins, Davis, and Carraway stabbed Garcia in the back at the last minute at the City Level. State Rep Yvonne Davis is known for her sneakly back dagger.  

 I am really disappointed with this panel of Hispanic Judges who also denied the public the right to comment and submit their maps.  There will not be justice until redistricting is taken out the hands of the incumbents.

The judicially mandated Texas Congressional map, while almost as badly gerrymandered as the originally approved map by the Texas Legislature, is still an improvement.  Texas is 55% minority but only 39%, or 14 of the 36 districts in the mandated map, one more than the originally approved map, are majority minority.  Meanwhile, if you study the numbers closely (linked from http://dallasredistricting2011... you will see that half of the 14 districts in the mandated map are over 80% minority while none of the 22 Anglo majority districts are over 77% Anglo.  This is obvious evidence of gerrymandering, packing as many minorities as possible into as few districts as possible.  Both maps did it!

Texas has a major problem with democracy, especially with giving equal rights to minorities.  How can we fight to impose democracy in other countries with the lives of our soldiers when this is what is happening back here at home?  Our soldiers, and our citizens, deserve much better than this!

Oh those wacky Texas republicans, always barking about how they dont believe in "legislating from the bench" and yet, this is what they're doing right here and now. Bunch of hypocrites..This is more about keeping the "non-whites" from actually gaining some sort of political power in this state. Time to face facts guys: America is becoming a minority-majority country, learn how to deal accordingly..
