Locked Out at Lost Society, Again (Update: Owner in Rockwall Jail for Meth Possession)
Owner Fernando Rosales -- who you may recall from this arresting episode in June 2010 -- met them at the door and showed them a lawsuit he said he'd filed against the city; he insisted he had a temporary injunction allowing him to stay open. Problem was, the case hadn't gone before a judge after all -- and appears never to have even been filed. (As opposed to Yucatan and Service Bar's pending legal action, which goes before a judge Monday.) Which is why, earlier this week, the City Attorney's Office had planned to file suit against Lost Society for violating the ordinance.
But sources say that on Tuesday, the club was raided by law enforcement officials. Originally we were told Drug Enforcement Administration officials went in, but the DEA denies that. Dallas Police Department and Dallas County Sheriff's Department officials also say: Not us. The city is still trying to determine who was responsible for the raid.
Nevertheless, Miles tells Unfair Park that her office "learned of something happening with the authorities [Tuesday], when I called [landlord] Roger Andres to conference with him and let him know we were filing a lawsuit against his corporate entity, which owns the property, and Lost Society. Fortunately the authorities' actions and those of the property owner have, for the moment, obviated the need for a lawsuit."
The lock-out notice you see above was posted this week -- by Andres Properties, which says Rosales is behind on rent. Roger and Marc Andres tried to kick out Rosales last year, following his arrest for filing a false application with the TABC, but Rosales found a judge to let him back in.
Update at 4:22 p.m.: There's a reason Lost Society's owner was unavailable for comment: Rosales is being held in the Rockwall County Jail on a charge of possession of a controlled substance. Jail officials tell Unfair Park he allegedly had more than 400 grams of methamphetamine, and is being held on $250,000 bond.
