Now We Have a Much Better Idea What Feds Want Hillwood to Produce in JWP Investigation

We've known since June 30 -- days after FBI agents raided the homes and offices of John Wiley Price and Kathy Nealy, among others -- that the feds had also paid a visit to Ross Perot Jr.'s Hillwood HQ. As Haynes and Boone's Barry McNeil told The News: "The FBI has served subpoenas to several clients of Kathy Nealy, and one of those clients is Hillwood." But till now, we never knew exactly what the feds were looking for.

Unfair Park has obtained an internal email sent to Hillwood employees on June 30 instructing them to "preserve both hard copy and electronic documents" related to "a Grand Jury Document Subpoena." Specifically, says the email, this is what Hillwood believed to be "potentially relevant ... to the issues in the government investigation":
  1. All documents created after January 1, 2002 that mention or relate to Kathy L. Nealy, Kathy L. Nealy & Associates or KLNA.
  2. All documents created after January 1, 2002 that mention or relate to Commissioner John Wiley Price III.
  3. All documents created after January 1, 2002 that mention or relate to the Dallas County Commissioners Court.
  4. All documents created after January 1, 2002 that mention or relate to any business, organization, or charity related to John Wiley Price III.
Documents created in the future. The continuing duty to preserve applies not just to documents that already exist, but also to documents created in the future. Accordingly, be sure to preserve all hard copy and electronic documents that fall within the subject matter categories above that you create or receive in the future.
The email goes on to instruct employees of Hillwood "to not make any judgment as to what might be unimportant or duplicative; all such documents must be preserved" and that "you will be contacted in the future about gathering the documents described above for review and production in the grand jury investigation."

McNeil is in trial and could not be reached, so Haynes and Boone's Larry Gaydos, who also reps Hillwood, was asked to verify the contents of the email. He would only say, "We got a subpoena for documents, and we're in the process of producing those. The government asked us not to discuss it, so we are honoring their request."

Hillwood, of course, is behind AllianceTexas, a direct competitor of Richard Allen's Dallas Logistics Hub inland port, in which Price and some pals wanted, ya know, equity.

In this situation, this black man will need to “roll” on theNorth Dallas establishment and the “South Dallas” religious establishment that planted him there 27 yearsago. He was the tap root tree. The FBI should know after listening to maybe100+ wire tap interceptions and ongoing monitoring of county businessactivities since 2002, they have a grandfather tree with a strong fibroushorizontal root system. If they uproot this tree, its roots system has spreadso far until it’s grown under the house (church) foundation, under the streets(layers of North Dallas), throughout the lawn area and into the neighbor’s yard(business friends and coat tail friends). In other words, when and IF they areable to find corruption, they must uproot the entire tree and screw up thewhole area where the roots have grown. That means the tap rooted ”SmartGrowth”  tree planted 27 years agoextended its root system all the way to North Dallas. If you’re trying to takeJWP down, take up the root system.

If the FBI can’t do that, they need to goback home. If JWP goes down by himself, only then will I believe it has racialovertones. See, if the tree leaves its roots intact, it will grow back againand it will be much stronger than it was before.

I agree with almost everything you write except this:  Even if only JWP goes down, I don't see racial overtones.

He's just not as smart as he thinks he is and he got caught.He overplayed and made  himself a target.

In fact, race is the only reason he'd get off.  The generation involved in prosecuting all of this thinks there would be race riots or something if JWP went down.  There wouldn't be.  The black middle class (mostly moved out of Dallas by now) is not going to riot.  Whites  are not going to riot.  The 60+ year old adults of any color are not going to riot.

If he gets jail time, it'll be in spite of his race, not because of it.

In my post, I specifically stated "If JWP goes down BY HIMSELF, ONLY THEN will I believe it has racial overtones".  But you're right, he is not as smart as he thought. He interwined himself with white family power brokers to the point he felt he could never be targeted.

Doesn't really seem to be that much here. The email follows standard e-discovery guidelines for preserving evidence. Hillwood sent out the email as a precaution so that they would not get nabbed for neglect of duty to preserve. It was already known that the subpoena related to JWP and Nealy was served on Hillwood. I guess the interesting item in the email would be the 2002 date.

My guess is the 2002 date is merely to get ten years of records. Corporations do not keep paper files any longer than very recent files. Those shredder parties are only for archaic government offices or the movies. Corporations all have the same text retrieval programs used by law firms. You can bet any e-files with any of those names are long gone, if any existed. Corporations unless under court order can dispose of records as they see fit. If anything you do not want some underling messing things up by destroying something of no value after the summons was served. That is the reason for the e-mail/memo.

The records that remain are financial. They have to stay. You can better believe those items are bullet proof. I still think the Perot link is money: how much money actually went into these various charities and funds. That is Commissioner Price's problem, not Mr. Perot's.

The commissioner does not have jack on anybody that pulled his strings. He got input from powerful people on the "right" decision. He also had lots of money coming in via various paths. You are not going to link the two paths. Only an incompetent like Don Hill and his entourage made that mistake. The commissioner's activities are over years and involve lots of actions to get the money and then spend it.

Would you watch a sitcom where Perot, Jr., and JWP have toshare a cell in a minimum-security federal joint?  They could have weeklyadventures on work furlough where they might meet up with Nealy.  Or someweeks they might be stuck in the yard with only a basketball hoop and aMavericks-themed basketball donated by Cuban.  Perot would constantly complain that, sure the Mavericks won the championship, but they didn't make enough money on it.
