Mayor Pro Tem Dr. Elba Garcia admits she helped remove John Loza from the DFW Airport board based on his position on the Trinity River toll road referendum.
When the Dallas City Council last week replaced former council member John Loza on the DFW Airport board with Brenda Reyes, we were reminded of the memorable 1997 battle between the two for the District 2 council seat. Reyes struggled with controversy early in her campaign, and she later spent time in the slammer after a nasty eye-scratching episode with her hubby.

Aside from Reyes's foibles, what really piqued our interest is why Loza, a seemingly effective board member, was ousted by someone with such obvious links to Mayor Tom Leppert. Reyes donated to the mayor's campaign, meets with him regularly and has collected nearly $200,000 in advertising and consulting payments from Leppert's mayoral campaign, Friends of Mayor Tom Leppert and Vote No! Save the Trinity, according to campaign finance reports and Leppert's calendar.

When we reached Loza for an explanation, he said "a certain Oak Cliff council member" told him "in no uncertain terms" that his appointment was not renewed because of his position on the Trinity River toll road referendum, as he actively supported the effort by TrinityVote to remove the road from Dallas's floodway.

We had a feeling Mayor Pro Tem Dr. Elba Garcia, chair of the committee recommending the appointees, was the council member in question. "That would be a good guess," he said.

Loza, a lawyer who served on the city council for eight years and began his term on the airport board in June 2007, says his removal has nothing to do with his performance or qualifications, and he was told by one of the five council members who supported him that the decision amounted to retribution.

"[Garcia] was under the impression that I had told her that I was not going to get involved in it -- I don't think I told anyone that -- and that I betrayed my promise when I got involved," Loza tells Unfair Park. "She just couldn't trust me is the way it was phrased to me."

Garcia says she told Loza before the 2007 referendum that the three Latino council members (herself, Steve Salazar and Pauline Medrano) supported the toll road, and they expected appointees to follow the leadership of the council. She then urged Loza to stand with them.

"He told me he would, but he didn't," Garcia says. "I take very seriously the commitment of the appointees to the council, especially when the three Latino council members supported him. There were no surprises. I was very open with him. He betrayed ... he didn't follow his word. OK? Let's put it that way."

But did she have any reservations about supporting someone so close with Leppert?

"Ms. Reyes was nominated by Mr. [Dwaine] Caraway and Mr. Salazar," Garcia says before darting off into her office to avoid further questions. "I supported that nomination."

Council member Angela Hunt, who voted to give Loza a second term and led the TrinityVote campaign, says she is unsure of the decision-making process used to select the appointees, and there was little discussion about the nominees as the process moved forward. Hunt claims she was never given a reason by Garcia regarding her support of Reyes over Loza.

Hunt says Garcia's decision is fiscally irresponsible because the DFW Airport is "such a huge business," and the city needs "the very best people" to run it.

"For Dr. Garcia to be basing her decision on political payback because John Loza didn't toe the line on the Trinity issue and actually came out in support of the common sense position, to me, that's irresponsible on her part," she says. "Elba was charged with a very large task of chairing this committee to find the very best candidate for the DFW board. To know now that her decision was based on petty political payback, that's just not good leadership."

Lillie Biggins, chair of DFW Airport board and vice president of operations at Harris Methodist Hospital in Fort Worth, hadn't heard about the two new appointees (Betty Culbreath, also nominated by Salazar and Caraway, replaced Sanmi Akinmulero) because she has been out of town. She describes Loza as a consummate professional who never missed meetings and always came prepared.

"I'm disappointed that John wasn't reappointed," Biggins says. "He made a very powerful, strong and committed board member. I will miss him because he added a lot of value to the board."

She cites Loza's political background as making him a "natural fit" for the board, and she says he asked the right questions and gave detailed and structured feedback.

"I thought he did an awesome job," Biggins says. "I'm very proud to have served with John on this board. He has certainly made the airport a better place for being there, and I mean that from the bottom of my heart."

Biggins has served on several boards and says serving on the airport board has proved to be the most important. "So much is dependent on it, but it's such a political instrument," she says. "I don't know how these mayors make these decisions."

Mayor Leppert was asked to comment, but he refused to do so through his chief of staff, Chris Heinbaugh, continuing a trend of staying silent. (He recently snubbed The Dallas Morning News regarding his plans to take over the Dallas Independent School District and his ties to Washington Mutual.) "The Mayor is not going to comment on this," Heinbaugh wrote in an e-mail.

Unfair Park submitted an open records request regarding the board nominees and received a list dated January 21 that did not include Reyes or anyone else in consideration for Loza's seat, with Loza receiving his nomination from Medrano. A subsequent request showed that Reyes's application was received January 22.

An analysis of campaign finance reports for Mayor Leppert, Friends of Mayor Tom Leppert and Vote No! Save the Trinity revealed that Reyes and her company, Arriba Solutions, has received a total of $197,739.65 from the three committees. Reyes also contributed $3,500 to Leppert's mayoral campaign.

After considering running for county judge in 2010, Loza says he has backed out of the race because "the waters will be too crowded." Dallas County Judge Jim Foster is expected to run for another term, with fellow Democrats Clay Jenkins, Sam Coats and Larry Duncan expected to compete in the primary. Cedar Hill City Council member and lawyer Wade Emmert is gaining momentum on the Republican side, and there has also been chatter about former Dallas City Council member and mayoral candidate Gary Griffith throwing his name into the mix for the GOP.

Loza remains steadfast in his position on the Trinity Turnpike, claiming it will never be built. "It's just real ironic, especially because the deeper we get into this whole Trinity thing, the more it turns out those of us on the other side were right about it," he says.

As for Leppert, Loza isn't optimistic that the mayor will be coming around to his way of thinking any time soon. "He's not the kinda guy who has enough guts to admit he's wrong," Loza says. "I wouldn't hold my breath; let's put it that way."

This article touches on why the DFW Airport Board so frequently implements decisions in a manner which benefits Fort Worth and Tarrant County to the detriment of the City of Dallas and Dallas County.

It is important to note that the DFW Airport is a business with over $5.6 BILLION in assets and $600 million in annual gross revenues. Additionally, unique among airports in the U.S., it has a Congressionally sanctioned mandate to monopolize passenger air traffic in North Texas (subject only to a limited carve-out for Love Field).

The City of Fort Worth approaches appointments to the Airport Board seriously... its candidates are consistently well qualified and united in an effort to use their positions to benefit their constituents, the residents of Fort Worth.

How does the City of Dallas approach its appointments? Very, very differently. First of all, the positions are considered to be patronage positions.... little/no emphasis is placed on qualifications for the position (exhibit A would be Sanmi Akinmulero, who just left the Board-- if you want a laugh, go find a copy of his resume). Appointees typically are valued not for their intellect, but their ability to do the following:
1) slavishly do the bidding of their political sponsors (and this includes all sorts of City of Dallas-related stuff);
2) donate heavily to the appropriate City Council members;
3) ensure that no-bid contracts awarded by DFW Airport go the "right people." (Under Texas state law, the DFW Airport Board enjoys a unique competitive bidding exemption.. as long as the Airport Board awards a contract to a minority-owned enterprise, no competitive bidding is required (EVEN BETWEEN THE FAVORED MINORITY BIDDERS). So, for example, let's say a highly qualified company owned by a Mexican American woman bids, say $1,000,000 to do a job at DFW Airport whereas a brand-new, inexperienced firm owned by a Mexican-American man (who happens, for sake of example, to be Elba Garcia's cousin) bids $1,500,000... who do you think has the inside track? For bonus points: describe in 1,000 words or less Congresswoman Eddie Bernice Johnson's qualifications to serve as a minority, passive partner in two DFW Airport retail concessions.

I have never, ever heard ANY discussion of managing DFW Airport for the benefit of the citizens of Dallas being used as a criteria for the actual selection of Board appointees.

Trivia question 1: when did the City of Ft. Worth receive an exemption from the DFW Airport Board's non-competition clause to allow the construction of Alliance Airport?

Trivia question 2: how much property tax does American Airlines pay each year on account of its DFW Airport operations and how much of it is apportioned to Dallas County versus Tarrant County?

Trivia question 3: given the fact that the Cities of Dallas and Fort Worth previously owned the mineral rights that Chesapeake recently leased.. who received the $100 million in proceeds and why?

Wylie H., you make some great comments. Fort Worth indeed, does it better at DFW Airport with their board appointments. Dallas Mayor Pro Tem Elba Garcia still has "Blood Money" on her hands with the $5,000 political campaign donation she accepted from the slumlord owner of the Dallas apartment where a Dallas police officer lost his life several months ago. You’d think she would have sense enough to donate that “Blood Money” to the family of the slain officer but that won’t happen. That issue will pop up when she runs for Dallas County Commissioner in 2010. Brenda Reyes made the news several years ago right here in a Dallas Observer Buzz article when she was arrested by the Dallas Police Department for beating up her husband. Her picture “Mug Shot” taken when she went to jail was arrested was real scary. With individuals like these two clowns from Dallas, Fort Worth will always do it better at DFW Airport.

Elba Garcia has a record of taking people off boards that are independent thinkers. Ask Bea Martinez why Elba took her off the DART board.

We ask why qualified people do not want to serve on boards and commissions? There is no appreciation by The Dallas City Council of the sacrifices that are made by citizens. Thanks to John Loza for his service on the DFW Airport Board and to the citizens of Dallas.

Voters will remember Elba when she tries to run for County Commissioner or another office.

The death of the DPD officer is a tragedy. One of the results of that death is that DPD as of this week has changed procedures for officers serving felony warrants to:

All officers are NOW to wear a bullet proof vest when serving warrants.

All officers are NOW to identify themselves as DPD PRIOR to entering a residence.

The officer that was killed did not identify himself as DPD and he was not wearing a vest. The shooter thought he was protecting himself from a home invasion. The death in this case is just so sad.

Of all the things that Elba Garcia is guilty of the death of the police officer is not one of them.

Elba Garcia, give back that "Blood Money" $5,000 campaign donation you accepted from the slumlord apartment owner of the apartments where Dallas Police Senior Corporal Norman Smith was killed by a well-known drug dealer a few months ago. At the very least, donate your $5,000 "Blood Money" to Corporal Smith's family. You are one sorry excuse for a public servant.

This whole thing stinks! John Loza was a good board member for the DFW Airport Board. His ousting was clearly political. Shame on Brenda Reyes, Mayor Leppert, and the council members that let this happen. Doesn't Dallas deserve better? I wonder what kind of retribution will exist for those people that come out against this convention center hotel. Seems like the citizens of Dallas lose the most...

I can tell you for a fact that John Loza was very vocal in his opposition to the tollroad referenum in 2007- he told me then point-blank when we were discussing what, if any, support or opposition I would offer. I don't think that he would have been running around town telling EVERYONE that he is not for the tollroad and that Elba just happened to miss that memo.

Watch what kind of dirty politics Elba Garcia will have to deal with when she runs in the democratic primary for the Dallas County Commissioner's Court Election in 2010. She will get a strong opponent in Dallas County Community College Trustee Diana Flores. Word is she will have clicking on all cylinders when she runs for that race. That race will get down and dirty. Bet Diana will rub that Blood Money all over Elba's face.

This is truly disgusting and sends a terrible message to Dallas' Latino community. Brenda Reyes is nothing more than a political thug with absolutely no interest in helping anyone but herself.

Shortly after Leppert was elected, I heard that she was in his inner circle and couldn't believe it.

Is there anyone in Leppert's inner circle with clean hands? Anyone who is with him to help the City of Dallas be a better place for its citizens instead of just helping to direct the flow of no-bid contracts?

I remember being a young man and going to the Greater Dallas Hispanic Chamber of Commerce--- stupidly thinking that they were an organization that helped Hispanic businesses-- I was so stupid.

Look at one of the Chamber's trustees--- Dr. Jim Rodriguez.... what makes him the guy to get a retail concession out at DFW Airport alongside Rep. Johnson? He's a dentist, not a retailer. (Then again, Rep. EB Johnson was a nurse... maybe the DFW Airport Board wants folks from the medical profession to have a cut of all the retailing action out at the airport.) I know a lot of really good Hispanic Dallas retailers that would kill for that kind of opportunity.

The more I learn about the way this City operates, the more it reminds me of things back in Mexico... to get any of really good minority contracts, it's more important to know the right people rather than have the best price or be any good at what you do. Then, of course, you're expected to give your sponsor or sponsors on the City Council a piece of the action for hooking you up.

Someone should cross-reference the names/affiliations of political donors to city council with the recipients of the fattest contracts.... a lot of these folks don't even live in the City of Dallas. Sometimes it seems like a bunch of well-connected people from outside the City with impure motives have more power in the government than those of us who live here and are just trying to make an honest living.
