Coming to the Defense of the Dallas County Public Defender

Brad Lollar

On Tuesday, Dallas County Chief Public Defender Brad Lollar resigned -- right about the time he was being forced out by Dallas County Commissioner John Wiley Price, who claimed Lollar wasn't very good at his job -- wasting money, wasting time. From jump, Scott Henson at Grits for Breakfast has questioned Price's reasoning and his methods, which just might lead to massive amounts of firings in the PD office. Yesterday, Henson wrote about how Dallas's PD office is actually more fiscally efficient than Tarrant County's, and today he writes that Price's "threat to fire large numbers of lawyers, slash the PD office budget or even eliminate it entirely" couldn't come at a worse time, pending a U.S. Supreme Court decision that will affect the point at which attorneys are assigned to cases.

Also worth a read: this 2005 Texas Task Force on Indigent Defense feasibility study that took a good, long look at Dallas, among other cities' public defender offices, and came to this conclusion: "In both misdemeanor and felony courts, where judges rely more heavily on public defenders for indigent defense, costs per case are substantially lower. Conversely, costs per case are highest where courts choose not to use public defenders." --Robert Wilonsky

I knew JWP was in trouble many years ago when I saw his shock troops marching around a hospital with signs that read 'No Justice, no peas'

Brad Lollar is a good man, and has done a commendable job for the PD office.

I didn't think it possible for my opinion of John Wiley Price to fall any lower, but I guess if you live long enough anything's possible...

Paul Davis says:

JWP is not the bad guy in this thing. In fact JWP is one of the few Democrats who actively tries to keep government cost down. He knows more about the jail and cost than any one else. Let's face it he runs the jail.

The public defender sounds good on paper but there is tremendous waste. Lets hope JWP keeps up his watchful eye

I'll have to respectfully disagree, real damn hard, with "JWP is not the bad guy in this thing". I think he's a grandstander, and a bully, and he's wanted the PD office's 2nd in command to be in charge for awhile, and this is the avenue he's chosen.

And what you apparently fail to realize, or choose to ignore, is that those accused without the means of hiring representation are going to have lawyers appointed for them, and we can either pay lawyers from private practice, or we can have a robust PD office. The latter seems more cost-effective to me, but then again I don't know more about the jail and costs than ANYONE else.

And would you care to elaborate on the "tremendous waste" that you threw out there without any supporting facts?

Walt says:

Does this mean the public defenders will have to start staying past 2:00pm?

Dallas County lost an outstanding person. This court has no spine to stand up to JWP's bullying.

Call me Ishmael says:

Where is Lewis Black when you need him? He would have a field day with the baffoonery of the Dallas County commissioners . It's like watching a permanently installed piece of boorish performance art that should have closed after the first night.

Bubba says:

I think you guys at the Observer ought to look at what's unfolding at the Public Defenders Office since Mr. Lollar's departure. Vetting of personnel files by Commissioner Price (and how did he get them?), a public information request by the DMN, a political supporter (evidenced by a $100 campaign contribution) of Commissioner Price now running the show and going about the business of firing staff.
