Sloppyworld is Illegal

Early this morning over on DC9, Rich Lopez posted word that John Freeman has closed down the newish yet already beloved Sloppyworld -- only because, well, five Dallas police officers and an assistant city attorney made him.

See, Freeman -- the genius behind Dooms U.K., Dutch Treats and about 539 other bands over the years -- does not yet have a Certificate of Occupancy for the Expo Park venue at 3601 Parry Avenue (the old Millennium spot). Unfair Park spoke a short time ago with Raul Martinez, assistant director for building inspection, and he said Freeman applied for a C.O. on January 24, but that it's under review -- and opening a venue during the review process isn't allowed, not at all. "They should not have opened," Martinez says.

According to city records, the City Attorney's Office issued Freeman a citation for illegal use of property on February 23. And Freeman acknowledges he received it -- it happened, after all, during the weekend of Melodica Festival.

"I was told two different things by a million different people," Freeman tells Unfair Park today. "I was under the impression I could have events there ... Then, last night, when we were about to have the show cops showed up and the assistant D.A. in charge of code enforcement said, 'You can't even be in here.'"

From all accounts, it sounds like a misunderstanding that could have been easily cleared up with a little, oh, clarity. Because according to Freeman, he's paid a good dozen visits to the Oak Cliff Municipal Center to get the Certificate of Occupancy. And, in January, he plunked down his dough and got his official okee-doke -- only, not so much. All he got was a receipt that said, in essence: You've paid to begin the process of getting a C.O. It did not allow him to open the venue.

"No business can open without a C.O.," Martinez says. "We've been having a lot of cases lately where people submit for a C.O. and pay their fee and walk away with a piece of paper that says 'C.O. in review,' and they think it's their C.O. and it's not. We've had to explain that a lot."

At some point, and he says he doesn't know when, Freeman will have to go to court to defend the illegal use of property charge. Maureen Milligan, the assistant city attorney handling the case, says she wants to help Freeman get the place back open. But she was also there last night, closing it down.

"When we visited Mr. Freeman last night, I know he's frustrated with getting different answers form different personnel at City Hall, and would work with him to make it go more smoothly," Milligan says. "But we did inform him he can't operate without a C.O. That's what our community prosecution team does, though: As long as business owners and property owners are willing to work and comply with the code, we will do our very best to help them work and comply with the code."

One thing is certain at this point: Sloppyworld is closed till further notice. And though Freeman insists the Negativland show scheduled for April 20 will go on, he doesn't know where.

"I'm like, 'What the fuck?' and I guess that was my bad," Freeman says. "As of now, it's in limbo. It ain't over till it's over, but I need lots of help. At this point, I don't know what I'm gonna do. It's such a hassle. I'm talking to my lawyer tomorrow."

At least it sounds like Freeman will be able to get the joint back up and running. Damn shame about Darkside and Elm St. though.

Why would anyone start a business without consulting a lawyer and having them do all the dirty work for you? They say most bars and restaurants fail due to undercapitalization, but this is ridiculous.

Sounds like John will get rolling again and that's a good thing. Sad that all Elm Street Bar/Darkside rates is a half a line on a blog.

I've been through the blood and the mud there. And I know I'm not the only one, I ran into Frank last night and he looked like someone shot his dog.

When I had to get a COO for my office space, the people were very informative about the process. You pay the fee and then wait for the three inspectors to give you green tags. Pretty simple. I blame landlords, mine never mentioned it even after I signed lease agreement.

yeah that sucks about elm street/darkside. The only upside is hopefully it will make July Alley stronger and more able to weather the storms.

as for sloppyworld i dunno. Seems to me that you shouldn't have occupants without a certificate of occupancy. But yeah, i can totally see getting inconsistent information from the city. I learned that through the SUP efforts a while back.

It is somewhat confusing, and I'm sorry he's having problems, but use the resources that are available or hire a professional to handle it, Sloppyworld is, after all, a business. P.S. I'm guessing he is having to do a "change of use" which *does* require a huge amount of rigamarole.

Thanks for the support and advice. I am seeing what is up and if it is salvageable at all. BUT: the awesome show that was booked at SW for Sat. night featuring Famous Amos (Jason Amos of the old school, Argo-era's new band) plus two smoking local acts: Jack With One Eye & Rtb2 has been moved once again to Amsterdam. Thanks to Mike for being such a mensch. See everyone there. All proceeds go to the bands and the Sloppyworld legal defense fund...

The main problem was that the address for sloppyworld did NOT exist, and you can't get a C.O. for a place that isn't there. John spent the better part of a year trying to get the address established. Which means when he first started trying to apply for permits, (building, C.O. getting the utilities turned on, ect.) they wouldn't even give him the paperwork because the city had no record of the address. Millennium, the business that was in that spot before us, may have run in to the same problem, because they NEVER even had a C.O. They operated for 10 years without one, and they were probably able to fly under the radar because they were an antique store, and didn't do any additional build out. If they had had a C.O., all we would have needed to do would be to file for a "change of use", but trying to prove that 3601 Perry even existed, and applying for a new CO for a "new" address has taken almost 14 months.
The point is we've be getting conflicting info from code enforcement, police, city hall and oak cliff. It's a lot to wade through and very expensive and time consuming. We only have a 2 year lease, and most of that time has been spent flailing around in red tape.
So thanks "Citizen Obvious"! We had no idea it was that easy!

But the owner had a "Clean & Show" permit 10/2006. And there are multiple permits for the address in 1984.

If the city has previous permits for Sloppyworld's address I don't understand how they can think the address doesn't exist.

Look for what it's worth, I'm all for local music and venues and I wish you the best, despite the occasional sarcasm.

This whole certificate of occupancy thing they have set up here in Dallas(Texas?) is really whacked.

It seems completely ridiculous to me, that a landlord can rent out a property without it already having this certificate.

That it falls on the tenant, who is locked into a lease, to obtain the permit is so backward.
