SUP, Deep Ellum Club Owners?

Late yesterday, I was told that the owners of several long-established live-music venues in Deep Ellum club did not know they had till the end of the year to get specific use permits -- SUPs -- from the city in order to keep their doors open. Far as they knew, only new clubs had to follow the procedure -- a process so torturous that in January, it drove off Kenny Brattain, who had wanted to re-open Trees following its demise due to bankruptcy. Turns out, everyone needs 'em -- and the clubs are feeling "blindsided," says one Deep Ellum vet, who warns of "a collective uproar" over this issue.

In June 2006, the Deep Ellum Foundation got the city council to create the SUP process, in order to keep out tattoo parlors and other, ya know, troublesome elements -- which is to say, the under-age dance clubs that welcomed the alleged hoodlums some folks claimed were running wild in the streets. All the older clubs were grandfathered in -- so they thought. Turns out, yeah, not so much, says Barry Annino, the president of the Deep Ellum Foundation and a member of the Deep Ellum Public Improvement District board, who was behind last year's SUP victory.

I e-mailed Annino last night about the confusion. His response -- and more -- after the jump.

Last night, Annino told Unfair Park via e-mail: "All grandfathers [have been] thrown out for clubs and bars. All clubs and bars must have a SUP by December 30. All clubs and bars over 2,500 ft. must have parking: one (remote parking) space for every 100 feet over 2,500."

I then sent him a bunch of questions, among them: When did this happen, anyway? And how? And did the club owners know about this before it happened? Annino told me to give him a ring, so I did. And this is what he said.

"That was never the case. That was never mentioned. There were no grandfathered clubs."

So, I asked him, the club owners just took it for granted that they didn't have to get a SUP?

"They must have," Annino said. "All I can tell you is the property owners knew the deal."

When I told Annino the names of three specific clubs whose owners I was told had no idea they needed to get a SUP, he said, in short, Not possible. He insists that since last year, there was at least one meeting at the Gypsy Tea Room to discuss the SUP process, and there was plenty of info made available to landlords and club operators regarding the change in regulations.

"The property owners had a year and a half to know," he says. "They were all in the process. Everyone who owns a building knows the deal. And if a bar doesn't know they need to talk to the property owner, because there's no other way to tell you."

Far as he's concerned, the clubs who claim they were taken by surprise are "in denial."

"All the clubs were grandfathered in before the ordinance change in '06, because most of them were big," Annino says. "Europa's 14,000 square feet, and they have 12 parking places. The Bone is 4,000 square feet without any parking at all, and they were all grandfathered in because there was nothing but clubs. But everyone said we need to go back to the way it should be: If you're 2,500 square feet and under, there are no parking requirements, but for everyone else, parking is required."

So all the clubs have till the end of the year to take care of business. What happens if they don't get their SUPs? Well, they could face fines from the city or get shut down, with the latter a real possibility. And Annino has no sympathy for them who don't get it done.

"The property owner can say they don't know, but it's like running a red light and saying, 'I didn't know it meant stop,'" Annino says. "In 18 months, you'd thik the word would have gotten around to the clubs." If it hasn't before, perhaps it just did now. --Robert Wilonsky

So, if property owners were looking for the quickest way to rid themselves of tenants (so they could sell out to a developer, right?) - maybe witholding information like this would suffice? But shouldn't the city code enforcement agency have notified club proprietors of any rule change? Surely they can't legally rely on a non-governmental agency like DEF to do their job for them. Although, shouldn't the DEF have the best interest of their constituent businesses in mind - and shouldn't they have been flogging said businesses to get this done?

And I generally hate conspiracy theories.

Can someone explain to me reason for the parking/sq. foot ratio requirement? Obviously, people need a place to park and all, but it doesn't seem like a good reason to shut a place down.

The only positive thing that can be done is to get the info. to the clubs ASAP. I had to do some serious digging to get these documents, and a friend had to go to city hall physically to get the deadlines.

The Deadline is Wednesday the 19th OF SEPTEMBER.

That's less than one week.

DEEP is taking hefty measures to get the word out to all clubs. We need architectural/engineer/survey help fast.

Oh yeah, these SUP meetings... first time I've heard that and I AM an active involved citizen.

Everyone should also know that Don Cass DID tell his tenants.

Here's an email sent to me from Alison, one of our members, about who's doing what. This list is by no means comprehensive and we're working with everyone to make sure they get their apps submitted.

Here's what I got from being out in person yesterday evening:

Red Blood Club: Doesn't even have the SUP packet. They just found out about it yesterday. I gave them the info on where to find it and the deadline/city hall contact info. They need as much help as possible.

Adairs: Has the info. packet. They are scrambling to get their stuff together, but they need architectural help. I gave them the deadline info. and city hall contact info.

Elm St. Bar: Had the SUP packet, but did NOT know deadline. I gave deadline and city hall contact info to Wes. He and Mike are going over everything today.

The Velvet Hooka: This is awesome. Apparently DON CASS IS THE ONLY LANDLORD THAT TOLD HIS TENNANTS. Velvet Hooka has been to City Hall, and City Hall is having a tough time labeling them, so they aren't even sure what's going on with their hearings, but all their info. is in. They are on top of it. They made a few extra copies for me.

The Bone: I love Rhonda. She is the one who got all this info. for us. She made copies. She and her lawyer are already on top of their stuff.

Elm St. Tattoo: Has their sign up, and is waiting for hearing date. They have a lawyer working with them.

Club One: Needs Deadline info. and architectural help. Please get the contact info. and deadline info. to Byron ASAP.

July Alley: I've been told that they aren't even going to try. Someone should confirm this.

Pharmacy: Approved.

Tiggers: Approved.

Taboo Tattoo: Approved.

Reno's: 1st hearing on Sept. 20th @ City Hall in Council Chambers. I have Alan's # and I am supposed to call him with a list of people that need architectural help today. I am just going to mention Red Blood Club, Adair's, Club One, and Elm St. Bar. I need specific contact info. on ALL of these places, so if Alex can get that to me in the next couple hours, I'll get it to Alan.

Wow! I got it. If we get it, we are lucky for a year and then we have to do it again. The whole area is already rezoned for Uptown and Property taxes go up to Uptown prices next year which means Rent goes up. We can get it but we will most likely just last a year and then we have to renew with a less likely chance to win the SUP again. We are being run out. With out owning the property we are srewed . Don Blanton could sell us out with out notice. With all the construction that will be coming in the next year , Sales will be down meaning less income . I love Dallas :)

I don't get it. There seems to be tons of parking spaces where buildings once stood.(behind Trees & Reno's, next to Bakers Ribs not to mention the city lots under 30) Between those and the new super cool DART line coming in, which can bring people in & out w/out vehicles, why are spaces required?

The clubs ought to have their liquor distributors lobby the city council. I'm sure they remember when Ellum was happening and would love to see it revived. I'd bet they might even have more clout than Westdale or their puppet Annino.

I was a contractor in Deep Ellum throughout the 90's. I was fortunate to have worked with many Deep Ellum landlords and club owners. Most had a genuine desire to see Deep Ellum grow without changing its past or personality.
In contrast, Barry Annino always came off as a slick bullshit artist who's main concern was self promotion. Why he has been at the helm of a sinking ship for so long I'll never understand. Deep Ellum needs leaders who will hold sacred the historical Deep Ellum. Not the future glass and steel nothingness that developers are forcing up our backside.

How often do people actually complain to the City that they can't find a place to park in Deep Ellum? How many times have tenants actually complained to the City that other tenants in the neighborhood are taking up too much of the parking?

Is parking really the issue here, or is it being used by the City and/or the DEF to further an exclusionary agenda?

I am going to post a link on SaveDeepEllum.org to this article. I honestly feel that the SUPs are a croc of shit and with all of the metered spaces and pay parking lots I don't see how it is fair to require parking. It's Deep Ellum, I walk anytime I have to go anywhere in this neighborhood and don't see where a place like Europa is going to fine another large enough parking lot without having to purchase a portion of one of the pay lots. Deep Ellum was not originally designed with parking in mind, and most of the lots we have today are where other buildings once stood. Come on people lets just raze the whole neighborhood and turn it into one huge fucking parking lot.

I haven't had a problem parking in Deep Ellum for the last year. Not once. I've been down there two or three times a week, parked in lots and at meters with no problem. I suspect this parking requirement is not based on reality.

I think it is actually the majority of District 2. I might be totally wrong. Alison left a comment on SaveDeepEllum.org about a DEEP meeting (ambiguously) tonight @ Mama Mia's @ 9pm. Anyone have confirmation if this is tonight?

Got a call back from Pauline Medrano's office. Turns out there are no fewer then 5 different types of SUP's in Deep Ellum. Her assistant said that the process for getting an extension takes longer then a week so we may be out of time here. Hopefully, the hysteria is over an SUP deadline that doesn't apply to those who haven't submitted their applications. That could also be a reason why land lords did not inform their tenants.

Hopefully that is the case and all DEEP has to do is apologize for overreacting... but i doubt we're that lucky.

I believe that is the case. Tiffany told me that someone on Parry was having problems with a SUP as well. I will txt Angelika and ask her to contact Monkey Bar, New Amsterdam, Bar of Soap, Meridian (though they may be exempt since they serve a lot of food), Minc, and any others i missed.

If the city really wants to bust somebody's balls over parking spaces, I've heard there's an area in town called Greenville Avenue that could probably use a dose of reformation...

Thanks to whoever dropped off the packet with this info off to us today. We are likely in need of this permit as well, since this is considered deep ellum by the city. I've let soap, monkey bar, meridian, fallout, & expo cafe know. None of these businesses with the exception of Meridian had any idea. I'll see the others in a bit. Our landlord's atty will be back tomorrow, so we'll know more.

Thanks again to Alison for gathering this info, & thanks to whomever dropped the info to us this morning. We all really appreciate it.

Is lower greenville having to put up with this? Good luck finding parking over there! There's never a problem parking in deep ellum, but I'm curious if it's getting singled out over places that would might even benefit from such a thing.

I believe lower greenville has its own SUP requirements that are different from Deep Ellum's. I think the whole SUP thing came about because Deep Ellum was the only place in Dallas that didn't have one. So, if you couldn't get a bar opened anywhere else you came to Deep Ellum to do it. That's why we ended up with so many problem clubs. The SUP was originally intended to be a good thing, when it was being formed about a year ago I honestly believed it was a step in the right direction. It has been changed and manipulated though to become a tool to help finish off the "leveling" of what we know as Deep Ellum.

With the amount of bars/clubs not informed of the SUP I can't help but believe there's malicious intent in keeping them in the dark until it is too late. The number of bar owners who do not know about the SUP deadline is in the double digits now. How can that be a honest mistake!?

Lets focus on what we can do.

We can inform the clubs and bars.

We can inform the liquor reps.

We can band together to form an action plan.

We have to move now. There must be no bickering on Tuesday. We need an agenda with as much info. as possible. I will be out here in a little bit to make sure other clubs are informed.

Do not just think that because the city mandates something that they have done it in a legal manner. We need lawyers to look over these aspects. If we say "Oh well, it's too tough," then we give them the right to do this.

Whatever the intentions this remains: city officials never informed these businesses. Landlords are not city officials and they do not have the power to be the sole dictators of new law. If they did sign some agreement saying that they would inform the bars and clubs, then they are liable and should be taken to court.

I've heard it mentioned several times, but I must reitterate. Why is parking so damned important for Deep Ellum? With the new DART rail opening up soon, the city should be encouraging pedestrian friendly bars & restaurants instead of running them out of town. Imagining another West Village in Deep Ellum makes me want to vomit...

Yes Expo is in the same boat. We just found out on Friday. Our landlord said nothing to us about it. Mike from Amsterdam sent me the packet as well to Fallout.. I have no excuses just hope to get it done and we all stay open. We shall see!

Too little too late. The changes were designed to close businesses who failed to "enhance the Deep Ellum experience". We all know who they are, so let's stop kidding ourselves. Every newspaper, including the Observer ran articles regarding the zoning changes. Every TV station ran stories about the changes... The Deep Ellum association held meetings and sent dozens of emails. I attended several meetings and spoke to most of the club owners. Most of them were there.
The Deep Ellum we used to know and love is dead and gone. The time to get involved was two years ago. Game over!

Well, The Amsterdam Bar, Minc, Fallout, & Monkey Bar all filed our paperwork. Others surely did as well, look for the proposed rezoning signs in the windows for the within the next 14 days. I'd like to say thanks to the folks at the city offices for helping walk us through this process. Now that y'all know exactly where we are all at, come in & have a drink. You folks were great. It's just compliance. All of use are used to it. On to the next step in the process. Likely, the worst part is over.

My family owns the Monkey Bar in Dallas near Deep Ellum in Exposition Park. We completed the SUP application process with 4 days notice (thanks to fellow bar owners). Our property owner never notified us, so we have been blindsided with this whole process. We participated in a hearing today and clearly had neighbors lined up against us complaining of noise and general "element" issues that goes with running a patio bar, they complained against the "element" of folks who drink and enjoy our little neighborhood bar (as if we restrict it to any particular type). If you have been to Monkey, you know that we welcome everyone. We thought it was just a compliance hearing, but it was an official hearing and our neighbors clearly do not want a bar in their neighborhood. They gave us one week to work things out with the neighbors before they make a decision to deny or allow the permit. This is a completely unfair "closed" government process and to quote one of our famous neighbors who plays for the Cowboys who happens to live behind Monkey Bar, "if it smells like a rat and it looks like a rat, then it probably is a rat." I live in Austin and don't know all of the political detail, but I do work in Texas politics and see the writing on the wall. My family is shocked that the Expo Park community would allow such aggression, but I guess if it is ever going to look "just like Uptown", the are going to need to remove the old character first. This is something we tried to tell everyone a year ago. DEEP ELLUM as we knew it is GONE. FUCK DALLAS, they have killed a beautiful place. It was an artist dream, a natural underground scene. Now it is going to be a Mockingbird Station.

Here is how it has happen, as I see it.

Why would Dart put a rail station in Deep Ellum? For weekend travelers? No sorry, they want daily commuters. They want people to live in Deep Ellum, thinking they are cool, and going to work in Plano. So, why is Dart building the rail station in Deep Ellum when there is one downtown?

It was not only the City of Dallas, but Barry Annino and Jeff Swaney. Jeff owns a lot of real estate in Deep Ellum. And is ex-partner, Barry is the head of DEA and several other associations. I was told by Barry, that if our SUP went before the Dallas City Council, he would deny it. He stated that the Dallas City Council will call him as the expert on Deep Ellum and he offers the Council his comment. They will accept it and deny any and all SUPs that Barry does not approve.


This is not about the historic buildings, the art, music or lifestyle in the old Deep Ellum, it is only greed. Please read below, this is what is posted on the treeslives myspace.


"Barry Annino and Jeff Swaney are business partners that own most of the Deep Ellum Real Estate. They are the ones who would not allow "TREES" to reopen. They are the ones, who want everyone out of Deep Ellum so they can sell their property to developers and make a lot of money. Ironically Jeff Swaney was the original owner of "Club Clearview."

So that is why I say FUCK DALLAS.

On another note, the City of Lewisville loves us, and all bars/clubs. The police actually work with us and even help people that can't find us, by allowing the people to follow their Police Car to Fat Daddy's. There are no SUPs. It is just simple, easy and cheap to operate here. Only because the City of Lewisville wants us here. We are now BYOB and they love it. BTW you can smoke inside our venue, while you drink your beer. We are only 20 min from Dallas, 20 min from Denton and 30 min from Ft. Worth. In a weird sort-of-way, I am happy that we did not move to Deep Ellum, we never realized how good we have it here.


One more thing that really bothers me. How the hell did "The Door" get the approval from the City of Dallas to move into the Gypsy building? And, how did they get their SUP so fast?

it's weird seeing so many of you use the words "fuck dallas... dallas killed this place... etc" you must realize it is not "dallas" that is doing anything... it is the people of dallas. and by that i mean the clientelle that have been frequenting the deep ellum area.

i personally have not been to deep ellum in years. only a few specific visits here and there, but i try to avoid the place as much as possible. i remember when it was all going down. getting followed and yelled at by bums and thugs. cars being broken into. being told to NEVER park anywhere near Malcom X Blvd. getting lost and fearing for my life. the only safe time to be there was during the day or early evening.. and many times nothing was even open yet. what a waste.

if you want to get mad at someone, blame someone, blame the people that turned deep ellum into the slum it is now. the clubs and bars should have seen this coming. they should have been focusing on what kind of clientelle they allowed to frequent their places. maybe they should have raised prices or placed a dress code?

they did nothing to prevent this. it is their own fault. they depended on their tenure to save them... and that is just a little cocky in my opinion.

again, dallas didn't do this.. the people did it to themselves and now dallas is trying to clean it up.

To tell ya the truth, I bet DEE did not actually read the article. Okay DEE, if your argument is, it is the Club's fault for letting in the "Bad" crowd, then explain the following:

DEE, I do not think the homeless really need a parking space, do you? I guess all the "THUG'S" getaway cars would actually pay and park. Then the "THUGS" would hop out, walk down the street to torment people.

Yea, it was HORRIBLE when we were at the old TREES building at night. I mean DAMN, we met pizza delivery people, people walking their dogs and other nice people.

DEE this is all about Dallas, DART, Jeff and Barry. It is called GREED and SCREW the historic buildings.

Deep Ellum is/was the only thing about Dallas that made it interesting and if people are too jaded to see that then let them hang around yuppie bars with popped collars. Fuck em.
