TABC Dismisses Complaint Against Katy Trail Ice House

Back in January we published a blog post that described some tense negotiations between Park Towers residents and the nearby Katy Trail Ice House. Condominium residents had filed a complaint with the Texas Alcoholic Beverage Commission, alleging noise from the outdoor beer garden infringed on their otherwise peaceful Park Towers existence. Today, the Dallas Morning News reports that the disagreement has been dismissed.

Although we understand your concerns about the noise issue, there were only three complaints filed with the police within the past two years. Therefore, without some additional evidence that a violation of law will or has occurred, there are insufficient grounds to conduct a protest hearing or deny the application under the Code at this time.

Hopefully everyone at the Park Tower Condominium will hit up Amazon, buy a nice pair of Sennheiser's and live and let live. But the language in the dismissal certainly leaves things open, should other area residents decide to complain about the bar.

Hopefully that won't happen. The Katy Trail Ice House is still one of the best places to watch baseball outside, and if you haven't noticed, opening day isn't all that far away.

I find it funny that people who willingly moved directly under a Love Field final approach are complaining about noise. As an even closer resident, I can attest a private plane is far louder than the drunk masses.

The thing that would bother me the most wouldn't be the din, or the noise; it would be the incredibly unreal "chris chris" stories emanating from the patio.  After several hundred "hey brah's" and "Affliction rocks!" shouts, I'd be ready to fill my ears with super glue.

I like many people dealing with noise issues in the area have learned the hard way that it is almost impossible to get the police to do anything about noise complaints with businesses with regards to outdoor music. They can be in clear violation of the law, you can be standing with an officer next to the plain and obvious violation and they will tell you you are wasting your time.

To be honest I am really disappointed that the Observer would take this postion without knowledge of the chronic frustration in this area with the police in regards to noise violation, I even had an officer chastise me for even bothering to waste his time with a noise complaint because Uptown is an entertainment district and as such businesses are not required to comply with noise ordinances. I was later given what I felt was a sincere apology by his supervisor saying the officer was completely wrong but that did nothing to solve my problem which was having the music turned down and a citation issued since they had been repeatedly reported and warned for the same issue.

@kergo1spaceship  that'd be like me assuming all the Plano restauramts are filled with soccer moms talking loudly about this year's cheerleader outfits. it's really more of a diverse crowd here, the weather's getting great come check it out. after a couple beers, look up at the balconies of the rich old folk of Park Towers and start yelling 'hey grampa, what's for supper?!!!'

@JaniceA @ChrisYu @kergo1spaceship I occasionally dine in Plano and I can assure you I am not a soccer mom or dad.  Places like Whiskey Cake, Fillmore Pub, Henry's Tavern, & Holy Grail have a diverse clientele.  Yeah, there are some soccer moms and they're just as prevalent  as the Uptown Douchenozzles, HP/UP elitest fake tits, and self-loathing artists I encounter in Dallas establishments.
